friend thinks enter usa on tourist visa, get married to us cit. and hey presto!

hope i am in right forum, a friend of mine here in london has met a us guy twice, first time 1 week in october, and second time 2 weeks in december, she went in on a tourist visa, she is a citizen of poland.

anyway they are in love and she and he think that all she needs to do is go back in 6 weeks to the states on the same tourist visa, get married to this guy and everything will be okay, she will get a visa to stay and eventually a green card and they live happily after after after.

i have explained she he needs to file a finace visa first and she needs to wait in europe, the immigration dept in the state, the call center told them, it was all fine their plan, i/e she comes in 6 weeks and they marry and welcome to the USA

I can't beleive it is this easy and have advised her to really check into this, and most of all make sure she is in love, 3 weeks romance and marriage, hmmm, doesn't really happen does it>

Entering on B2 with the intent to marry is against the rules of the B2 program.

The proper way is to file for a fiance visa. It may take longer initially but will be easier processing. This situation points to a hard time for proof of validity of marriage.

I would suggest the man worry about her using him simply for a GC. This situation is not "love". "True love waits" is a slogan for another time but is certainly appropriate for this case.
 
thank you for your quixk response, I thought the same route i.e. finace visa, i would add her only intention of moving is for him, not for GC, but i agree and have told her wait, she is ready to leave her job, apartment everrything, as you said i agree, true love waits, thanks again

Already having the intent to immigrate disqualifies her for entry as a nonimmigrant. Point out to her that to gain entry on her "tourist visa" she would have to LIE and COMMITT FRAUD upon entry. Then if she got married and filed for a greencard, her LIE and FRAUD would be found out and they would deny the greencard and make her leave the U.S. and go abroad to go through Consular Processing and make her file for a waiver of her MISREPRESENTATION.

Very bad idea.
