Fresh-mint USC, with wife and new-born baby still pending F2A interview

Can you please reconfirm me. I am in simila rsituation. I filed I-130 as F2A and we are expecting baby in 6 months. Now my question is that later in a stage when I130 is approved and date become current , all you need to update to NVC and add as new family memebr in DS230 when filing with NVC. This should automatically take care of getting baby IV same time with wife. Is this correct.

Do you expect to become a citizen before the baby is born, or before the F2A priority date becomes current? If neither is true, you don't have a similar situation.

If you become a citizen before the baby's birth, the baby would be a born US citizen (if certain other conditions have been met), and would not be attached to the F2A petition at all.
 
Lets say every thing is same as Carlz mentioned except no US citizenship status. Person is still greencard holder (not yet 5yrs eligible for citizenship) and f2a PD date becomes current and you have new family member to add. So you can add it in DS-230 form + pay additional $400 IV fee to NVC, that way baby will get greencard visa along with spouse. No need to worry about separate I130 filing procedure + pd waiting etc for new baby. Is this correct.

yes, if by the time your wife (or husband) f2a becomes current and you are still holding green card, then all you need to do is to call NVC and send your baby's birth certificate. NVC will take care of the rest from there (of course additional $400). no need for new I-130.
 
Thanks Carlz. One general question, I used wife's name as maiden name (before marriage her family name) in petition form I-130 and also her passport has her before marriage family name not mine. Does it matter. Since we got married 3-4 months back we did not have time to make change. I am just curious what did you put when you applied.
 
same here - actually my wife's still using her family name. i guess it does not matter as long as the marriage certificate and other documents showing you are legally binding couples.
 
Changing the wife's name to match yours is not very important. And changing it at this stage could cause delays. Deal with that after she is in the US with a GC.
