F-2 visa was rejected

Hi,

I am on a F-1 visa currently on practical training. I got married recently, my wife attended the visa interview in Chennai to obtain a F-2 visa.

However her visa was rejected, the consular officer told her "both u and your husband are students, also you have not travelled to any other country, hence I feel you and your husband may settle in the US and hence I am rejecting your visa."

I want to know what should I do next? Should I try reapplying for her F-2 visa (this time by post) or is it better if get an H-1b visa and get her on a H-4 visa.

F2 Visa

Sad to know that your wife\'s visa was rejected. I also faced similar situation my wifes visa was
rejected three times at the New Delhi Consulate. I do not want to discourage you but it is really difficult to get F2 visa after a denial. Going for an H1 is a better option. I did the same thing and my wife got H4 visa. We had to wait for almost two years. So try to get H1 visa as soon as possible. If you are interested in remaining a full time student then I would suggest that better go to Canada, instead of wasting time here.

F2 visa rejection

   My wife had a similar problem at the Chennai consulate and her F2 was rejected the first time she applied. The reason given was that I was a potential immigrant.However when she applied around 10 months later the officer at that time said that as each person is an individual, it would not be right to deny her a visa just because I may be a potential immigrant and she was given a 2 and a half year multiple entry F2 visa. Ofcourse this was back in 1995 and now we both hold green cards but my advise to you for what its worth is that you should not give up hope but when you (she)applies again, give a time gap and don\'t apply for the second time immediately.

Going to Mexico for F1

Iam from India, right now on a H4 visa. I have obtained admission to UT, Austin. I have to start from the next semester ( from Jan 14,2002). Does anyone know whether it is advisable to go to Mexico to obtain a F1 visa at this stage after the embassies have reopened for TCN (Third Country Nationals)? Please advice me. Its urgent.

Can a F-1 Student Invest in US Stocks or Mutual Funds ?

I am currently studying in California but would like to save some amount by investing in US Stock markets or Mutual Funds ? Is it legal for me to do so ? I am on F-1 Visa and will be on it for 2 more semesters.

Got laid off, want to change status to F1, got I20, but school will start until May 2002, If I file F1 now, start school on May, Do I loos the my status from now to May?

Need Information

I have applied for F2 Visa Twice.My Husband is in U.S.Both time i was rejected bcoz my Husband admission is Provisional.Now his Admission become regular and i got the letter also from his University stating that his status is being converted from Provisional To Regular.
Now shd i apply again for the 3rd time or shd i wait more?

Can some enlightened soul please clarify ?

I am currently on an H1. I will be completing 6 years around late June of 2003. I intend to go on a F1 and do my masters at that point of time. I have the following questions.

a) What documents would be needed to convert from H1 to F1 ?
b) Assuming all docs are correct where do i get it stamped ? If i am not leaving US during that period does the stamping matter ?
c) For a person to file the next H1 there has to be a one year gap between the first six years on H1 and the next three years. So will the student visa be sufficient as the gap between the 6th year on H1 and the 7th year on H1 ?
d) What kind of restrictions exist for F1 visa holders ? Is there a good website where this information is available ?
e) If during my F1 i were to get my Greencard approved will i need to be working \'actively\' with my employer(who sponsored the GC) at the time of receipt? The way i understand when you are on a F1 visa you are not alllowed to work.

Hmmm.... Too many ? not enough answers :(. Come on guys you are my only hope.

I filed for my husband they are asking for marriage ceritifcate. We were married in 1966. We didn\'t get a certificate. We have no evidence like photographs also..Is there any suggestion you can give.

INS is asking for marriage certificate for my husband\'s F-2 visa approval..he is in USA......i was married in 1970.....How do I get the marriage ceitifcate while sitting in USA. I have no eveidence as it was 30 years back when we got married. Is there a way to get marriage certificate from India ina genuine way. I have three kids. Plz help.

I am currently a student. I came here a year ago. Now, I am planning to apply for my wife\'s F-2 visa. Are there any specific do\'s and don\'ts for F-2 visa? It seems clause 214-b is being used more often than not, for this kind of visa. All my documenation is in place.
Any help is really appreciated.

F1 visa extension and marriage to H1-B visa holder

I am currently on F1 visa. My visa is expiring in May , I intend to go to India and get it stamped while comming back. I will be married to an H1-B visa holder when I go to India . Are there chances to get my visa get rejected because of marriage to a H1-B visa holder in US??? Please help.
 
Depends on your intent

What do you plan to do in future? Have you finished course work etc. to graduate by May or plan to come back and complete? There should be no problems to get F1 revalidated till you graduate. This has no impact on H1-B till you apply for H4 which again can be done in India itself or after graduation.
