FP taken before I-140 approved ???

Hi,

My case is as the following:
LC (RIR) : PD 8/23/2004 | AD 9/30/2006
Due to EB2, I file both I-140 & I-485 concurrently | RD 10/31/2006
FP taken on 11/18/2006.

On 1/4/2007, received RFE which suggest us to file under EB3 instead and they asked for my W2 from the beginning of my employement in this company. I have been staying with the same company ever since LC is filed. So, the lawyer suggests to file a second I-140 to apply under EB2 and let them approved the previous I-140 as EB3. I also plan to appeal if they denied my EB2.
RFE replied on 2/21/2007.

On 3/5/2007, lawyer and I received an approval notice for I-140. They approve the EB2.

Now, my question is what would happen since the FP has already taken?

That is good, your EB2 was approved and yo already did FP for the pending I-485, so no problem.

I guess one is never satisfy. What I mean is: when I got LC approved, I want to get I-140/I-485 approved. Then now, uscis approve I-140, and now I'm checking the website like crazy to find if any change or any approval.Good luck with ur case!
