The reasoning behind this is that due to no backlog for filiing I485, lots of people filed their I-485 application. In March the dates retrogressed. INS stopped sending FP notices for Sep99 through Mar00 because they did not want the people with PD not current to go and get FP done and then see the FP expire after one year. So what they did was that they kept sending FP notices to those who files after March 00. thinking that those people have their PDs current and they are likely to get their case adjudicated.
VSC took a stand that they will send FP notices to this Sep99/Mar00 people only when their files are ready to be adjudicated (file being open). Since now they are working on Oct cases, you\'ll notice that some Oct99 guys are getting FP notice.
This reasoning has so far seem to be valid. Many fellow board members like yoyo have developed this theory and it has been confirmed by IIOs as well.
