FP Notice received - EB3/India - PD 03/11/03 ---- Surprised

I got my FP Notice and is scheduled for 01/28/05 in Manchester, NH. I am little surprised as its been a while I saw any posts with FP notices. Also because; after PD retrogress got effective from Jan 1st.... My attorney had told that my case will not be touched until the PD becomes current on my case.... hence I had totally given up on my FP until my PD becomes current....

The FP notice is dated 12/23/04... does it mean I could hope anything good .... No Fee/Penalty for Dreaming right????

FP is scheduled by another department within USCIS. They schedule the FP even though some thing else may happen with your case. I did my FP just 15 days before my 140 was denied. In fact, by the time they had sent my FP notice they had already decided to deny my 140, even then I received the FP. This is a classic lack of coordination in USCIS. But I got an advantage because of this as when my case got reopened, they approved my 485 also (FP done and security check / name checks done)
