Former asylee to become a hearing witness(lay witness affidavit)

I was granted asylum since 2002 and now am waiting for my GC( already sudmit the "request for evidence" form to the INS last month). I was just wondering because since I have agreed to be my friend's witness for his upcoming hearing next month, he has told me that the attorney has already opened my asylum case.( I was detained by the police back home-no report was obtained because I bribed them, but him and his lawyer wanted me to tell the judge that my country indeed detain gay people and of course going to tell the judge that the reason I don't have the police report was because I was never brought back to the police station since I bribed them). I was just wondering is it a risk for me since they will or have already opened my case and that there's a possiblity that my asylum status will be revoked??? Or is it going to slow down my GC process? Or I shouldn't be worry because I am only be the witness for his hearing? What if his case got rejected? Are they going to re-evaluate my case? Or is it better that maybe I shouldn't appear to be his witness? Worry here, please advice. Thanks!!!

Well, this may help your friend to get approved.But as you know my friend, being a witness is not easy as a deal.You're gonna show up before the judge and it's not easy as you think.You're gonna have a lot of questions to answer to.All the answers have to be true and accurate.I'm not going to scare you but be prepared.It may go good or bad.This is gonna depend on how you're gonna hold the situation.If you get confused on what you're gonna be witnessing about and the judge finds some thing like you're a liar,YES this may affect your asylum status.IF you stand clear and right on your side you're not gonna be in trouble even if your friend gets denied.

I think you are totally right. I just don't know what kind of questions the judge will ask me. what if they want more evidence and I can't provide. I am so terrified because I really don't know what to think. My friend's lawyer was telling me that it only only takes about 20 mins or so for my testimonial and that they would prepare me for the hearing and they will ask me some questions and stuff. but they are not the main judge, they don't know what kind of quesitons or the evidence the judge want. But I feel bad if I don't help my friend but at the same time, I don't want to risk my own hard-earned status.

I dont think there is much to worry about. When our case went to the court I had my cousin and brother in law be our witness and neither of them had prepared for anything. Judge or INS attorney will ask some questions about you and what you do and then the real questions will come. Its not that bad, just dont screw it up for your friend.

They can. They have to have strong evidence such as fraud. It's unlikely they will reopen a case because of some discrepancy in the witness's testimony.

How did your attorney open your case. If your are witness, the other person’s asylum is at stake, why would someone else open your case. Or what relevance has it to do being witness.

I would not advice to you to acknowledge before a court of law that you bribed someone. That has bad connotation, and it can give any judge that your are liar.

Anyways it seems to me as you are explaining the situation that lawyers are tying your case with other person’s case. Like if this guy get why not this guy. I suggest that you stay away in this business, and just wait your greencard in peace. Don’t let incompetent lawyers screw up your case, and wish your friend the best luck.. good luck?

14ksusha- Have you ever seen such cases when you were working @ the immigration court?
Do you mean fraud on the original application? Why would anyone consider looking into it after asylum been approved?

Yes they can and do revoke asylum if they have evidence of fraud. The regulations have prescribed detailed procedures for revoking asylum.

yes indeed ,they can revoke anything start from visitor visa to citizenship.

Thanks so much guys. I just don't understand what's the meaning of opening my case for the judge. I guess what's the lawyer wanted to do is try to relate my case with his. I just only told the lawyer that I will be his witness without thinking carefuly. Now I have made my decision. I want to tell the lawyer that I am not going to appear for the court hearing for my friend. (I guess the first time they postponed the hearing was because my friend told the lawyer that I will be the witness that's why the lawyer proposed that to the judge) I hope it's ok since I didn't sign anything so that's no way for them to open the case?

Remember even if your asylum is not revoked, any bad marks on your application will remain there forever, and can put you into trouble for your creencard and citizenship. so it is good to stay clean. In many cases, I know many people who did small stupid stuff, and can't became citizen or get greencard. and remember you want to be a citizen, the important thing in America for is the freedom of citizenship.
As far as your friend is concerned, he should be ok. He does not need you. Immigrations judges have a pretty good idea on what is going on countries around the world. he just needs to make his case in good faith.
As for you you have made good decision. You are the lawyer of yourself.
There are at times when you need to distiquish yourself and others. Now do not confuse yourself with self. some psychological advice. and excuse me if I am being a dad talking to his kid., but my aim is just to advise the seriousness of the matter.......................

I called his lawyer today and I said I am not going to do it anymore and he replied to me as what if your friend got deported and I am like, he has to take care of his own since I got mine by myself with no ones help. and he just said ok and hang up. I hope everything is fine now and I don't want to bother by them anymore. I felt relief and now am waiting for my greencard. I sent mine RFE 2 months ago and I got a msg like " we received your response to our request for evidence or information. It is taking between 570 and 600 days for us to process this kind of case. However because preliminary processing was complete, the remaining processing time will be less than the maximum stated in this message. You will receive a written decision on this case." what does it mean?

You are safe MR. Just wait your greencard in peace. See the lawyer he likes when you were helping, but just hang up when you said you were not going to testify. People are people....

I guess you don't have a friend in question anymore. Boy, he/she will be upset! Generally, testifying in somebody else's case is safe and I have never seen a case reopened because there was a discrepancy in the witness's account. However, it does strengthen a case tremendously if there is a witness.
