Hi All-

I am about ready to fill out the I-I30 form, but I have a couple of questions about the form.

Information About Your Relative

16. Has your relative ever been under immigration proceedings?
What exactly does this mean? Does this mean has she ever been convicted of some kind of felony which leads her to an immigration hearing?

19. Your relative's address abroad.
My wife's is currently residing in NY and is on a H1-B Visa. She also has an address in Korea. Which address should I used for this question. I would think it is the Korea's address.

I am so sorry if I am asking really dumb questions. I just want to get it right the first time.

I have just one more question about form I-130.

Question 14 ask "If your relative is currently in the US, complete the following:
He or she arrived as a : .... "

What should i fill in for that question? My wife have been in the US for about 6 years now. She initially entered as a student for college. After college she got her H-1B. Should i say that she entered as a student or go straight to the H-1B? I am thinking if i say she entered as a student, then question after that ask for her I-94. Her I-94 should be the most recent one right?

You are correct my friend. The answer to that would be F-1 (student visa) because if u think about it, she entered US on her student visa and that's what the form is asking here. Later she could be changing status as many times. Yes, her I-94 should be the most recent one.
 
Thank you, but i have another question in relation to that then, on her form I-765, where it says class of admission, is that going to be the F-1 visa too or is it going to be the H-1B? Thank you much!
