I married foreign woman and her conitional 752 is drawing close to remove conditions.

The problem is she tryed to seduce my son. I want a divorce , she won't give me one unless I sign 1-751 that we are together and happily married. She has moved in with a man in another city and has not provided change of address either.....I cannot sign that she is with me so conditions removed.
I see there is a choice on part 2 choice D, where the marriage is made in good faith and she can get a waiver for divorce....I don't understand what the waiver is for?
If I don't sign to trmove conditions and she chooses part 2 d to get waiver...will they give her 10 yr greencard.
I have copies of chats with me where she talks about if I cooperate and sign for her, she will give divorce without seeking spousal support. In these chats she talks about staying illegally and shows she wants to get card fraudulantly....but, how does the waiver work....if there has been no divorce filed yet, does the waiver just give her time to file for divorce....I feel she has used marriage to just get her greencard

In order to obtain a waiver, THE ALIEN must show by a preponderance of evidence that the marriage started out real and a "good faith effort" was made to try to make the marriage work. There must be sufficient evidence if the "bona fides" of the marriage. Would your son go on record that she tried to seduce him? THAT would be VERY effective evidence. You can be proactive and submit COPIES of the e-mail where she is trying to strike a "bargain" for your cooperation. CONTACT ICE and USCIS about it. Address one copy to USCIS and cc: ICE, entitled it MARRIAGE FRAUD CASE! Be specific (without being graphic).

Get her *** deported and the I-864 is voided. Even with a divorce where she waives any alimony, you would still be on the hook via an intact I-864. YOU don't need her cooperation to get a divorce! See a divorce lawyer with some understanding of immigration matters. In fact, bring a copy of the I-864 and full instruction with you to a divorce lawyer. Put every nasty detail in the divorce paperwork to undermine any attempt she makes to get a waiver.

On another note: Did she ever start a fight with you that ended up with police involvement? Has she got ANY evidence to trump up a charge of "abuse"?
