Form I-129 and I-539 for TN

Hi, I was reading the forums and you have a lot of knowledge, that it is why I dare to post. I hope you can help me.

My husband has a TN visa expires on January 17 2014 and I have a TD visa that expires the same date. We will send the form I-129 with my form I-539, but I have the doubt of sending our original I-94 or copies and also our I-94 expires on same date January 17 2014.

1.- Can they denied our extension of stay because of this?
2.- Did you know if they send us back I-94 with extension of stay?

You never send your original I-94, you need this as proof of status. You send a copy.
As long as you send in the I-129/I-539 before 1/17/2014, you will remain is legal status pending theri approval. You will get new I-94's with the aproval notices.
