My labor was certified in Dec 2006 and I'm on 8th year extension of H-1B. Now, as part of career planning, my company has offered me a 2-4 year assignment outside US. My dilemma is as follows:
1. Due to the nature of assignment, I'll need to visit US at least 3-4 times a year, so will need some visa (visitor visa?)
2. The assignment will start from Q2'07, but I'll need to move to my new location sometime towards end of Q2'07 (so need to stay in US till then)
3. I'm planning to visit India in summer for visa renewal and also to see family
For visa renewal in India, I need to process my I-140 now, but, if I process my I-140 now, then in the future I'll have problems in getting a visitor visa (that whole thing about 'dual intent').
Any suggestions on what would be the best way out?
