Foreign national can not open mutual funds account in USA?

I just happened to notice a note
on a T. R Price fund new account form:
"After oct 1,2003, nonresident will not be able to
open any new aacount at T.R. Price".

I wonder if this is due to some law or private decision.
In such context, a resident/nonresident should be determined
by INS or IRS definition?

I am pretty sure that non-resident in this context is as per IRS definition.
 
Ameritrade *express* account

You need to be a citizen or a PR for using the express application with Ameritrade. You can ofcourse mail in the paper application with a copy of your passport and other info as part of the patriot act.
