9 FAM 40.51 N8 Labor Certification Indicates Higher
Wage Than Alien Currently Earning (TL:VISA-42; 01-30-1991):
In a situation where an alien is already working for the employer who
filed the labor certification, and the alien is currently earning a salary lower than the labor certification indicates the alien will be paid, the Department of Labor has determined that the higher wage need not be paid UNTIL the alien immigrates to the United States.
