For those who felt left out - this is the pace of VSC

While many are excited about the recent approvals of April and even May 2000 cases (ND), my Dec-99 case has just started to get their attention.

I called the VSC last night and the message has changed to "On May 07, we mailed you a notice to request further evidence...". Now I need to wait for this notice to find out what they are looking for and then respond.

I guess that this is just the "normal" pace of VSC. My case was an EB1 filed in Nov99 (RD) and received in Dec99 (ND). I did my finger prints on March 19 of this year and this is the first RFE.

For those in the similar situation: you just have to be a little more patient than those lucky ones. Perhaps our cases are all in an ultra-slow officer and he/she just came back from a long vacation.

By the way, anybody can tell me how long it usually takes to receive the RFE from the date they sent out? 2-3 days or over a week? Thanks!

It took only 2 days for my lawyer to receivee the rfe from the
the date avm updated that rfe had been sent out..

Shef, it is a relief to know they have gotten to your app. I too am an EB1 applicant from January 2000, and was informed a couple of weeks ago that they would get to my case in about 60-90 days. For some reason, I suspect they have held up EB1 cases. I thought it was because our PDs were relatively recent (my PD is 7/99), but I have seen other EB1s with PDs of 8/99 and 9/99 already get approval. So that theory was shot.

Could you please drop me a line regarding what RFE you got? Will help me get ready. :)

Also, what EB1 category have you applied under?

I don\'t know if ur lucky in getting an RFE. In my case (I\'m EB1 too, ND 10/22/99) an RFE was issued on 4/2 and mailed on 4/9. It eas recieved on 4/12 by my lawyer and responded to on 4/17. VSC still hasn\'t recvd it!! (Even though it was tracked and confirmed to have been delivered on 4/18).

I do not mean to dampen your spirits, and I hope you have better luck than me.

Dan Dan, what did the AVM say about your RFE? You mentioned two dates (4/2 & 4/9). For my case, the AVM said that "we mailed you a notice on 5/7...", does it mean that they may have NOT sent it out yet? I just try to figure out when I should call my lawyer instead of waiting for them to call me.

HVN: I guess you don\'t need to worry about the reply from the VSC customer service. Sometimes they may just repeat those "standard" answers and try to get you off the phone as soon as they can. Perhaps we all over-estimate the pace of VSC. My lawyer said that they still have lots of 1999 cases pending there, despite of all those early approvals we saw in this forum.

I called VSC around 4/4 and the IIO said that an RFE was issued on 4/2 but not mailed yet due to back log. On 4/9 the AVM changed to an RFE was mailed to you on 4/9, so in your case ur RFE has already been mailed on 5/7, ur lawyer should have already got it or be getting it any time now.

My RFE was for employment letter, past two years W2 and last three (months?) pay stubs. As the attorney handling my case is an employee of my company I never did see the RFE.

My ND is Oct 14, 1999
EB-1, India
FP: March 1st, 2001
No RFE
No news at all.

When I spoke to an IIO couple of times, They say my case is still on hold. Two weeks back when my attorney called them up, they said the same thing to her and they said since last year the dates have regressed for Indian and Chinese nationals, it takes time to get to our cases. Wet can we say to these kind of answers.

But officially, still INS is processing Oct 15, 1999 cases. That\'s the only one hope I am holding on with. More than that I don\'t know what we can do to expedite our cases.

It\'s really getting frustrated. We are at their mercy.

Generally speaking you should receive it within a week. My lawyer claims to have recieved it on April 17th for RFE which was mailed on 4/4 according to the RFE date. It was for Employment letter, last 2 months pay stubs and copies of my passport including visas.

One more EB1 here. The lawyer told me that EB1 cases should be processed much faster than cases in other category. Apparently it has not turned out that way. My PD is 11/98 and ND is 10/7/99. Currently I am in the process responding REF. It seems that my case is no faster than anybody else, including some EB3 and EB2 folks. I have the same feeling that VSC is holding back our cases for some unknown reasons.

By the way, my lawyer received REF in 4 days after they mailed them out.
