For those FBI Name Checking more than 6 months, you are 1%!

USCIS wants that money. They clearly stated if new proposed multiple year EAD is in place, they will lose revenue. They are planing to raise the fee for multi-year EAD. Got it? Those agencies are State corp. They never do business w/o profit. Also the whole layer of immi attorney is created by the defect of immigration system. What a great country!

GCIsTortoise, I guess you are damn right. I bet USCIS wouldn't dare to release the figure of revenue generated from those renewals. It is totally a lie that USCIS got cases backlog because of insufficient fund for hiring more people.

Even i'm on board in this category, pending name check for last 17 months.

I agree that comparing with 3 years, 7 months is not a big deal. But if it got stuck for more than 6 months, probably it will get stuck for years. We need to find a way to solve this problem. I heard from someone that filing law suit may help speeding up name check process. Anyone has the similar experience?

I've heard it's probable to file a suit if your case is pending
in name check for more than 2 years (but I'm not sure if they
count time from 485 RD or even PD?). But it costs you money.

USCIS would not tell when they initiated the check.
1st time they quoted "name check" was last June.
So it would be 11 or 12 months old by now...

smartgege, I don't mean to break bad news but
yours probably 11 month old too since your 485 RD/finger
print date is similar with mine. Name check is initiated
sometime soon after 485 filing. Background check is
added to the whole checking process after you finger printed...

You are right. According to the USCIS response, my case is pending on background check.

For the law suit thing, it does cost money, but I am just not sure if it's risky. If it won't have negative impact on the case, I think it's worth to try.
 
You can find out when ..

Take an Infopass appointment, go to your local/nearest USCIS office, speak to an officer and in my experience, they told me when they sent the inquiry to FBI - 7th May 2003.

I asked if they can send one more - but then, they said, my app will be at the bottom of the pile.

My theory is this. If your name is John Smith, good luck to you. However, if your name is Xerxezwerty Brouhahadeedeebooboo, you are clean. FBI name check looks at your name and its possible variants and if you are a witness in any of the known cases, your case is stuck.

Hindsight 20/20

As I said earlier, the only real recourse is a Writ of Mandamus. I am checking with my lawyer how much more would it cost me to go this route.

7 month does not necessarily mean that you are on the long list of waiting people - it may simply be that your name has not been fed into their processors.

The kind lady at USCIS had told me that FBI had a goal to clear all pending name checks some time in 2005 - but that apparently did not happen. What had happend was that they cleared about 100K names in a week (or was it a month?) - so there is hope yet for folks with less than 1 year in this state.

There is NO visas available for citizens of India with priority date of
03/05/01 and classification of EB-3. Visas are only available up to
priority
date 03/01/01. Keep in eye on the visa bulletin board.

Well my Name Check has been pending for the past 17 months. I had sent and email on April 28, 2006 and received the above email today. Is this good news? Does it mean my FBI Name Check is cleared? I had contacted Senator B. Boxer and also taken an infopass appt. with San Jose local office. At the San Jose office I was told Name check is pending and we don't know when this will clear?

Does above message mean now my name check is cleared? I had specifically asked in my email what is the status of Name check!

Any feedback is appreciated!

I will believe that I`m stucked in Security Checks When I see EB3s case PD>30APR01 geting approvals.
