Jan'02 Folks Working on EAD...Please send ur EAD renewals ASAP. I spoke to my lawyer today morning and he asked me to file EAD extension ASAP as INS may take 60-90 days to process. Mine & my wife is expiring 02/01/03. As my wife is working on EAD, Iam filing renewal for both. Don't know whether $240 is worth or not.

Just curious what happens when you dont apply for the EAD renewal is it illegal to work ,the status is not illegal I guess.....

I would take a chance and wait till my RD Jan 29th '02 to renew my EAD ....

If you are currently working on EAD and if your EAD gets expired before your GC approval, then your current employer may terminate you and you may be in a deep trouble. So my advice is spend $120 and be on a safer side.

I relocated to Chicago and changed employer would it mean I am inviting RFE filing for a EAD renewal ahead of time ?? Thats what scares me a bit .

I changed employer after 180 days though ...and What about the AP??

I relocated from VA by the way saw u r from there too Magesh.

It is not a matter of 'may' - the empoyer is required to remove you from the payroll once your EAD has expired.
When you moved to Chicago - you are required to report the change of address within 10 days of move. Even though the INS may not touch the AR-11 form that you submitted at all, the burden of proof that you have reported your change of address lies on you. The EAD renewal form does not have any fields for reporting the name of your employer, but they will catch your change of address. Whether this will trigger an RFE or transfer on your I-485, it depends on the officer who is going to adjudicate your case.

If you are using your EAD and you dont have an approval by your EAD end date (and you dont have an EAD renewed at that time), your employer legally cannot place on the payroll.

Unlike 485, EAD "approval" is required and not just an "apllied for" status. You can walk in and get an EAD from a local office if its been more than 90 days since you applied. Which is why mahesh suggests you to apply at least before 90 days of your EAD end date.

I dont know when your EAD ends but if your EAD RD is not 90 days ahead of your expiry and you dont have your green card approval, legally no one can employ you.

Its up to you to wait. But the way things are going and with holiday season approaching, you might have problems. It wouldnt hurt to apply soon unless you are particular about not spending your $. again up to you... think about it
