how a canadian pr can bring in their spouse?

folks, i would appreciate your suggestions, facts and any help with my questions below:

my friend, who got his landing papers now and has to land before sep 30, 2003. now he is planning to get married. now his questions are:

1. should he get married after he completes the landing process in say, sep 2003?

2. is there any problem if he gets married before he lands? if so, what are the implications? (he has applied for PR as single / primary applicant)

3. if he completes his landing process in sep 2003, then gets married say in oct / nov 2003, then how long does he have to wait to get his wife into canada?

4. what is the process to go about in getting PR for his wife in the spouse category?

5. is there a temporary spouse visa or something that she can get to accompany my friend to canada? if so, how difficult it is to get that and what is the process involved in it?

6. is there any other way that she can join my friend immediately after getting married, like getting h4 for h1 visa holder?

7. can she take a visitor visa and accompany my friend to canada? if so, typically how long will she get a visitor visa for? can she extend her visitor visa, later from within canada?

sorry for asking too many questions folks, but my friend is in a confused state right now and i just want to ease his pressure. thanks in advance to everyone who gives info. that they know.

cantar02,

sorry, was trying to catch up with the posts that I missed in my 3 weeks of absence/vacation. As Ray stated, your friend should land before he gets married. After he completes his landing process, he can get married and sponsor his spouse. The processing for sponsoring immediate family members have changed. i.e, your friend should be alble to submit his sponsorship application along with the forms which the benificiary has to fill and also complete the medicals. He dosen't have to wait for the sponsorship approval first. This will speed up the process.

Sorry Cnatar02 for using your space ....

Vault, can you please tell me which casino you went to last week (recall reading about it in one of your post) ?

Thanks.

thanks very much Ray & Vault for your replies.

Vault - a follow up question for you.... so upon submitting the sponsorship application and the forms from the benificiary, what is the timeframe that my friend should look at, before his wife can join him? she will be in india while my friend will be in canada. any idea on that? is the process for spouse sponsorship well outlaid in the CIC website?

NiagaraFalls Casino. This is close to Queenston/Lewiston POE.

vault - another question.

can my friend land in sep 2003 and then come back to india immediately, get married and apply for his wife's PR from india? is that even possible? if so, would he have to apply to canadian consulate in delhi or a CIC office in canada? or should he be residing in canada to apply for his wife's PR?

Currently the CPC is working on cases filed in March 2003. The total processing time could be anywhere form 8 months and above. This also depends on the Foreign post (Consulates) work load. There is lot of information available on the CIC's web site. Your friend should download the Manual from the link below, so that he/she gets an idea about the processing.

Your friend can land in Canada. He should wait till he gets his PR Card in Mail. (So that the CIC folks don't raise eyebrows). Then he can travel to India and get married. He has to be physically in Canada to file the sponsorship papers. He can ask his spouse to complete the medicals while he is still in India, and bring the proof of medicals with him. He cannot apply to the Canadian Consulate in Delhi. He has to submit his sponsorship application to the CPC in Mississauga, ON.

Please make sure you send a check for $350 for this advise :D (Just kiddin)

Vault,

I gave landing in October 2002, grabbed PR card then came back to my home country, Pakistan. Got married here in Feb. 2003 and nowadays residing here for sometime. Now I want to file for my wife so that she goes with me next time i move to Canada.

I have couple of questions here:

i) Can I go to Canada, file for her and then come back to Pakistan ? While the case under process in Canada ?

ii) She is expecting a baby in December this year, how can I get the papers done for the baby as well ?

Thanks,
Ozzy Fan
