For GC holder out of country, any inconvenience to US address holder

Hi,

I have a US Green Card but have temporarily relocated to India. I pay my US
taxes , credit cards etc. and but do not maintain a residence in the US. For
that purpose , I had given the INS a close friends address.

However, that friend has also moved out of the country and I am now in
search of another friend to use for my address requirements.

Before I call another friend, is there anything that they should know before
hand - like does the INS require them to have a particular relationship with
me or more importantly will I be putting them in any kind of inconvenience
other than the occasional mail from the government.

Thanks,
GCH

Shouldn't be much of an inconvenience for that person.

On the other hand - you might have lost your green card already. Just be aware that you cannot abandon your primary residence in the US and keep your green card at the same time. And, as mentioned many times on this forum, it is not enough now to come to the US for a short visit between stays abroad for six months.

Giving the address of a friend will not be a problem. You better apply for a Re-entry permit before you leave the US.

Yes i have already applied for the Re Entry permit.

I have also been fortunate enough to visit the US once every six months for work ( sometimes staying for many months) so there should not be any problems.

How long did it take for you to get the Reentry permit since you filed in local BCIS? What do we need to keep in US to maintain the green card status except for Reentry Permit? Bank, credit card account? I heard that storage room is also a suggestion to show that you haven't abandoned the residence in US. Is that optional or necessary?

I am planning to work in Canada starting next spring for two years (that is the limit for the Re Entry permit). After two years, I will come back to US. I like to know if there is possibility that I can apply for rentry permit again after staying a while in US.

luk12,

The 2 year re-entry permit can be extended (or you you re-apply; not sure on the technical difference). My cousin and her husband used this procedure to work in the Middle East. They've been doing it for several years (I think going on 4) and visit the US every year. You must return permanently before the permit expires unless you have a new one.

Now here's one thing they told me which was interesting. When they last came to the US, they encountered a very friendly and helpful immigration officer who talked with them for a while. He mentioned that the immigration officer at the POE has the discretion to take the green cards at the POE if he/she feels they are not planning on staying permanently.

I hate to mention only part of this since I don't have all the details, but the moral of the story is: 1. Don't listen to just anyone, particularly on an internet site :). 2. Consulting a good immigration lawyer BEFORE you leave the United States is probably not a bad idea.

best wishes,
sadiq

Thanks for the reply.
If I want to reapply, is there any time break required between two reentry applications?

Thanks!
