I am starting new thread for people for Nabraska Center .Please submitting for Concurrent filling I-140 and I-485 for the months of Feb, Mar , Apr , May,June,July 2005.............Lets see when we reach our goals

NSC Updates - 04/12/05

Current focus issues with respect to I-140 and I-485 processing:

1. With the effect of visa regression, the center is attempting to simplify I-140 and I-485 processing and the center has taken over the practice of adjudicating the I-140s with I-485s.

2. In cases when the I-140 is refused, the I-485 along with any riding applications will also be refused. If the I-140 is approved, the I-485 and other riding applications will be returned to the work distribution unit. This transformation will make sure all I-140s are adjudicated in the like timeframes with the goal being to adjudicate I-140's within six months by September 30, 2005. This will allow the center to focus adjudicative attention on only the oldest I-485s instead of splitting it between the oldest stand alones and the oldest concurrents.

3. The specialization of having officers focus on either I-140 or I-485 adjudication instead of both should allow the center to achieve greater productivity on both.

4. Important Note: No changes should be made by filers in the way they file.

I got my EAD and hoping to through I-140 soon........Are there any more approval from Feb , Mar, Apr,May 2005 Receipt Date (RD) . Please post the detail here.

Cannot believe this new record by NSC I-140 in 34 days………

I want to let this forum know that I got my I-140 approved today within 34 days………you can shot your questions if you have.
Plese post detail if you have applied concurrent in Feb , MAr, Apr ,May 2005..Let Track Them...........

My 485 LUD changed on both the date of my 140 approval and a day after it.

140 RD 03/04/05 ND 03/07/05 AD 05/16/05 (No LUD change until approval)
485 RD 03/04/05 ND 03/07/05 LUD 04/22,25,26/05 (probably FP related), 05/16,17/05
FP/biometrics (code 3) completed on 04/22/05

Thats a good sign you may get I-485 approval soon.
 
I-140

My I-140 receipt notice is 04/13/2005 but I didn't file concurrent as per company requrement .Here are few questions if you can answer .
1.How do I know they file under EB-2 or EB-3 as they filed for substitute labor .Are Eb-2 fast then Eb-3?
2.Also what time you guys things it take to get I-140 approved as my PD for labor is dec 2002.?
3.Can I file for EAD without applying I-485 .

HI Avi,
Ans 1 --Best thing will be ask the lawyer. but as per you labor details it seem they have filed under EB3. At NSC they is nothing like EB2 fast then EB3 . As per my personnel expirence i have EB3 and i for I 140 got in 34 days.



Ans 2---I-140 is not depand on PD it the I-485 which is depand on PD. But as ur receipt date is near to mine , i can say thay are surely going to touch ur case within day or so.

Ans 3---No, to apply for EAD you have to apply for I-485,And I485 you can only apply when ur PD become current.Right now it Jun2002 and ur is Dec 2002 . hope it will reach there soon.

My husband's lawyer applied 140/485/ead on 5/12/05. We have not received the receipt yet. How long does it take to get the receipt? My husband's pd is 03/01.

It takes 1-2 weeks . So still you have some time. Do not worry your lawyer will get it within 2 week time.
 
Thanks for answering these questions . One last thing ,since your I-140 cleared in 34 days was it your labor or substitute labor.

Hi,

Looking your post, I felt good. My notice data for I-140 is April 19th 2005. I have not received approval yet. Do you think your case was rare case or do they process I-140 fast these days. Mine is EB2 cateory. My lawyer told me that it take 150 to 180 days Which is contrary to what I saw in your case. DCan you comment?

Hi jmccoy123,
That is the standard message which your lawyer has told you. You get this message when ever you do online and check you status. But I know couple for people who got approval with RD in Apr 2005. So I will `also now loose the hope for you. Get approval in 34 days could be too fast to believe but I can say you can count on 60 - 90 days as NSC has changed a lot in last 3 months.

Well here you are Mr FastTrack. I got my I-140 approved today after 37 days. Thanks for giving me inspiration. The problem I have now is that My Lawyer filed I485 just 3 days ago. I was wondering what will happen to that now. Had I known that my I140 will come fast I would gone for consular processing to India. Do you have any thoughs?
