hi Bob/Al/and all.


I have a question for my friend who just applied for his N400.

He first came to the US on a H1B(Comp A) sponsored his H1 and he came to the US through them. He was with for almost 9 months and then during that time the company wanted to sponsor his GC through Comp A's attorney.

So, the process began. In the interim due to economic Situations, my friend found another project and Comp A themselves spoke to Comp B and also helped Comp B with all the paper work and transferred my friends H1 from Comp A to Comp B.

LC was approved, 140 was filed. That also got approved.

It was time for my friend to apply for his 1-485. He was still on his H1. Went to India got married came back along with his wife.

He applied for EAD/ Advanced Parole. That got approved as well. After almost 2 years and 2 months he finally got his green card that Company A had applied and company A actually never hired him as they had mutually agreed with him as he got a better offer.( Same job , Same description) much better salary.

He has always maintained extremely co-ordinal relationships and just close to when applying for N400.

Company A contacted him to let him know that he is now eligible for N400 and even had their own Attorney help him.

So my friend applied for N400. Will it create any problems for him during Interview if he is asked about his Sponsoring GC employer.

He also was willing to work for Comp A but since he had found a better job, comp A themselves let him go and join the new company. He did not break any rules, or create any sort of tifff etc.
 
So comp A sponsored him for GC, he left for comp B, but he still continued the GC process with comp A even though he was no longer employed by them?
 
They wanted to employ him at a later date, but because the market was bad and they themselves found him a job with another company and allowed him to work for Company B. My friend also found a better job with higher pay as well.

What I'm saying is he still continued the GC process with company A even though he was no longer employed by them, correct? Sounds like he should be covered by AC21 since his I-485 was pending for so long.

This doesnt sound like clear AC21..From the time of I140 filing to today, how long has your friend been in Comp A (who processed his greencard) payroll.
