Following-to-join benefits for spouses

Hello everybody

I have a question about following-to-join benefits for Spouses. My husband got green card through DV lottery. We were married at this time, but I did not apply for green card, because I was subject to 2 year home residence because of J1 visa. So I stayed home and did not accompany him to USA.
So can my husband apply for me to get following-to-join benefits for Spouses after expiration of 2 year of home residence?
what are procedures and requirements?

I have checked USCIS website but I did not fully understand if I am eligible for this benefits or not. If anybody has relevant experience please share.

Many thanks

if it is still the same fiscal year in which he won and you can get the visa before Sep 30 - yes, you are eligible for following-to-join benefits. Seeing how it's already Sep 21, even if it is the same fiscal year, I don't see how you would manage to get the visa in the next week or so.

Were you already married to him when he was going through the DV process? Were you reported on his DV application? If the answers are Yes to the first and No to the second question, you are ineligible to receive a green card via FTJ, and his own green card will be revoked if USCIS discovers the situation. Spouse and all children must be listed, even if they will not accompany the primary applicant.

The DV instructions say the following:
SPOUSE INFORMATION – Name, Date of Birth, Gender, City/Town of Birth, Country of Birth, and Photograph. Failure to list your spouse will result in disqualification of the principal applicant and refusal of all visas in the case at the time of the visa interview.

Thanks for your answers!

site above does not say anything about this.

I have a question on following up benefits for spouces.
We won DV2010 with my husband and my husband is getting his visa on monday.I can't get mine because my meds were put on hold for 8 weeks. So when I'll get my meds the 2010 dv will have been closed is there away I can get the benefit?

Submitting your DV question in different topics in a Family-based immigration subforum doesn't help you much.

If you don't get your DV visa by Sep 30, you don't get any benefits. However, your husband can file I-130 for you as soon as he becomes an LPR (green card holder), and, hopefully, your priority date will become current within a year or two.
