My wife has just came to USA on H-4 status. The Social Security Office woulnd't give her the SSN, unless she has the permission to work.

I am about to send in the I-485 application to USCIS as a "follow to join" case, do I have to fill in the SSN column or I could just leave it blank.

I would appreciate your quick answers.

follow to join question

Hi,

My wife is on H4(valid till Sep 2005) went to India for vacation. I am planning to file I-140 and I-485,EAD except AP after my labor approved. Is it possible? Can i do this using "follow to join" method. I am expecting her to be back after 3 months from now.

Is it true that when you file I-485 the dependents must be in US. Please share your thoughts.

Thanks

No, this is not the case. If your wife has an H-4 then she can return back, provided (and this is VERY important) that you maintain H-1 status until she is back in the US. You can apply for the EAD and AP (and I suggest you might want to apply for both) but make sure you keep your H-1 job and don't moonlight with the EAD once it is approved until she is in the US.

Once she sets foot in the US, get her medical done and file her I-485/131/765 ASAP. But don't want for her to return to get your process started.
