Flying within the US,while awaiting extension decision

My company has filed for an extenion of my B1 visa, on 24th May'05. I am yet to receive the receipt. Is it Ok to be flying within the US, while waiting for the decision (on extension) of the INS.

Not OK , if your I 94 validity expires. If you caught at air port, you will be behind the bars.

BTW: Great_Guru, who checks I-94 when you fly domestic?

I dont think it is an issue if you fly domestic. Keep the receipt of your extension filed.

BTW: I am not an attorney and dont pretend to be one.

Here question comes if you do not have a receipt.

Yes, security/Police checks at airport randomly if you are suspicious.


FYI, even traffic police checks on the road the status. Even if you have driver's license

Do not be ignorance , what happening around you. All the states are not same

I disagree, Security at the airport which is provided by TSA is not a law enforcement division. Also, they do not have any authority to enforce immigration laws.
Traffic police also do not have the authority to enforce immigration laws. Even if the cop know you are here illegally or out of status, he/she does not have the authority to arrest you for that.
What do u mean by saying "All the states are not same". Immigration law is a federal responsibility and it is the same in all the states.

Hello, Security and traffic police ultimately handover the people to Immigration enforcement officers, they are availble in the airport too.

Immigration officer will do their job, (do you know what they will do if you have expired I 94 papers) once they find you do not have the papers.

It any cost nobody should first of all live without any legel papers, then how can they travel.

Your arguments support to illegals only.

If every thing goes on well(it is dicy)you may be OK.
other wise what greatguru mentioned is right.
ma21 is saying the police or some security are not authorized to check
your immigration status.It is wrong.There were some cases in courts where
routine traffic checks by cops inquiring the status of travellers and sub sequently detained for verification of statusThe aulthority was challenged
but it was upheld. check case law on this issues,you can find some.Stay with what greatguru is mentioning.
If you are not questioned it is your luck.This is not scare you but to mention
the perils if you don't carry VALID DOCS.(what ever they mean in your case)

Please read a little about this country and its history before commenting on it. This country does very little non-criminal interior enforcement, and it has never done that.

what legal papers are u talking about? Are you telling me that immigration officer will come into my house to check my immigration status? A local cop will ask me my immigration status?

So, you want to hide with out any legal papers in your home. Right? I clearly mentioned with expired i 94 card and no extention receipt (you are not legal in US even if you hide in your kitchen or bath room, Cops will come one day or later).

Well said Participant. Here discussion is travelling/living without legal documents (expired I 94 and no receipt for extn). Whether police checks or pilot checks who cares. Is there any body accept 'MA21', Is it legal hiding in kitchen with out any legal papers, because COPS or immg officer never comes to your kitchen?

As I said, no response is warranted for pointless blather and fear mongering. In my 15 years of stay in this country, not once has any law enforcement officer, any airline security person (and I fly a lot), any airport security personal, not one person other than INS inspector at the border has asked for immigration status. So, you can quote all the news reports you want, the bottom line is if you are here legally, there is nothing to fear.

The reason I say Blather, is the guy who started this thread is entered here legally and the filed for extension of status which retain his legal status. So where did you jump to the conclusion about illegals.
So, New Mexico hospitals can ask for your status, they cannot report you to Immigration, just like if DMV, can ask you for status and SSN, if they determine that your status is expired or the SSN specified is incorrect, they will not arrest or deport you right there. Arrest can be only be done by the immigration officers and deportation orders can be only issued by immigration judges. Immigration is a federal subject and states have no say in it.
