Fiscal Year and timmings-am I on schedule?

Hi!

I've been up and down looking for answers to my case, but haven't found a concrete one yet. I hope anyone can give me a light on this.

This is the situation:
I have an interview by the end of this month. I'm going on vacation for almost a month to USA.
Suppose the interview turns out fine and they want to make a contract with me for a year, for example.

Doubts:

-When can the Company fill in and turn the H1B application for me?
-If she does, can they only deliver it on April 1st next year :(? And if she does, do I have to wait until then and only start working from that date?
-The fiscal year starts on October 1st every year. Does that mean I can only work starting that day? I suppose I cannot start this year since they didn't fill on time and the 65 thousand H1B have already been given?
-Is it worth going to the interview since I cannot work if they can't fill in for the H1B within the next few months?

Thanks :D

Here is my answer below.

H1B applications can be filed only in April 1. So you have to wait for next April.

Yes, you are rite, but if you are exceptionallly qualified or eligible, you can also file for "O" visa.

-The fiscal year starts on October 1st every year. Does that mean I can only work starting that day? I suppose I cannot start this year since they didn't fill on time and the 65 thousand H1B have already been given?

You are rite, though your H1B petition is filed on April 2008. You can start working from October 1 only.

-Is it worth going to the interview since I cannot work if they can't fill in for the H1B within the next few months.

Its left to you. However, if your propetive company has any Indian subsidiary's, I would advice you to join that company as you will be eligible for an L1 Visa by next May.

Thanks, Robert, for the quick answer.

Unfortunately, I suppose I'll have to wait and see how it turns out.

Thanks again ;)
