Too Optimistic Said

It is too optimistic to say that June 2003 is closed.

Out of four workers I have to my location, all them filers from June 2003 and having I-140 approved for more than a year and fingerprints done for almost a year, only one got approved so far. He is an Indian fellow, EB2. His receipt date was 21 of June. What is curious, the remainder of three is from countries having nothing to do with retrogression so far (one of them is from Canada, with a very old priority date), and still they did not receive anything, not even an RFE. My LUD is almost the same as day one. If I would not have changed my address, probably now I would have had the same dumb message and date as day one of processing. Now I am stuck with the stupid message of change of address.

I track particularly the 30th of June, my receipt day. As of last Sunday, there are no more than 27% of applications approved.

However, there are some RFE's statuses very old, stating that NSC sent RFE, but never received the answer. Some of them may have been approved as well, and not updated.

As to the effect of retrogression, I do not consider it would be extremely big. I guess about 65% of the employment based applications, together with their dependents are from the countries subject to retrogression. I have o idea how many are EB3, but I think that no more than half of them. In consequence, with only 30-35% of cases shelved, I don't think the remainder will be solved anytime soon.

Concerning the so-called shelving, I have the feeling that NCS did not do anything particularly to shelve applications. They take normally files from rack and, when they see that some of them are not eligible for approval, they shelve them or issue RFE to prepare them...

Deepsoul,

I agree on some of the ppl are still waiting for there approvals but remmeber from the history of 2001/2002 NSC approves only 55% ~ 59% from the total filers, and having 37% approved already, and with retrogression for the EB3 category that will make June 2003 almost closed.

I don't have exact number for the number of ppls out of the EB3 catogory who are still waiting, but I think they are very a few %.

NSC approves daily tens of cases from june only and very few from after that.
