MY STORY
I am an Indian citizen. I am getting my H1 stamped in Toronto. I worked for company A on I-797 approval. I thne switched to company B on I-797 transfer (still no H1). After working for company B for about 8 months, I am going to Toronto for first time H1 stamping. My bachelors and master has all been in the US.

QUESTION
1. What ties can I establish to my home country India ?
2. Can anyone else who has a similar background describe their experience ?
3. How long did it take to get visa back after approval. Please provide dates when you actually got the visa stamped.

You can go to Toronto, Canada for visa stamping. Answers below:
1. H-1B is dual intent, so you should be okay.
2. I don't have a similar experience. But I had 3 H-1B stampings in India.
3. Consulates in Canada will return the passport (with H-1B visa stamped) on the next day.

Thank You for your answers sir.
Follow up on 1: However, can they questions like why Canada for H1-B stamping as opposed to India ? I would be a landed immigrant in Canada when this happens. Would this affect anything.

Follow up on 3: Is the next day returning from recent experience ? Can you give me a date/post on these forums when someone had it stamped in Toronto.

4. This is very trivial. I was looking for cheap hotels near the Toronto embassy (Toronto downtown). Was wondering if anyone has any ideas.

5. How long did your India stamping experience take? What documents are sufficient to show ties to home country. My parents own some property there. Can I show that they own some property (not me) in India but not me and hence I will be coming back to India .

No, since you have Canadian permanent residency you can get stamped in Canada.

What documents are sufficient to show ties to home country.

None. You do not need to show ties to your home country, since you do not need to overcome the immigrant intent presumption.

Thank You.

However, I dont have Canadian PR yet. But I will be a landed immigrant and then get H1-B (maybe within a short span of hours of being a landed immigrant).

Can the US embassy ask me what is your status in Canada? Is the right anwser permanent resident or landed immigrant. They can percieve this in different ways, correct ?

Secondly, I am thinking from another angle but need to know, what ties would I need to show if we ignore this Canada PR thing and I was getting it stamped in India ?

thank you sir.
1. Did they give you back the passport the same day ?
2. What questions did they ask you ?

1. Why your first H1 at 2005 was rejected in chennai?, I said reason, the VO seems satisfied. And then few simple questions like where are you working now etc.
2. Since I am living in vancouver they will send the passports by canada post with in 4 days.

new immigrant

hi! was just wondering if you have an idea on how i can deal with the following concerns:

my already have my visa for permanent residence in canada and i plan to enter this coming december. on the other hand, i got myself a return ticket to manila after a month to make final settlements (selling and disposing some properties) before fully migrating. will this have an effect when the immigration officer interview me?

also, do i have to bring and show the full amount required for the proof of settlement fund (CA$ 10,200) when i enter even if i intend to initially stay for a month with a letter from my relatives (canadian citizens) that they will support me meantime that i am establishing myself there?

would appreciate your inputs. thank you very much.

Are you talking about H-1B visa interview? In that case Canadian residency has nothing to do with U.S. immigration.

BTW - please re-post your question on Canadian immigration group in this forum.
