First Time H1 Stamping (Bombay Consulate): 1st visit Refused.

Hello Guys,

If you got a minute, can you pl go through my post and let me know your opinions/advise.

I came to USA in Aug 1999 on a F-1 visa. My F-1 visa was valid / stamped till May 2001. I graduated in May 2001 and was on OPT till Jun 2002. While on OPT I did not have much income. I got my H-1 visa in Aug 2002, and started working full-time on H-1 visa in Sep 2002. I have never been to India since I came here in Aug 1999. I am planning to go to India in next month or so and get my H-1 visa stamped in Mumbai.

Does anybody know of similar case. Or any advise on the documents or possible questions. What are the chances that my visa will get stamped.

Whats your alternative? Can you get it stamped in US/Mexico/Canada?
 
I have to get it stamped either in mexico, canada or mumbai. I do not know if mexico/canada would be preferable to mumbai.

Lawyers usually prefer to say - go get it stamped in your home country. That way you dont get stranded in Canada / Mexico if they refuse it. But if you already have a visa/something that will let you back in to the usa, probably stamp in Canada/Mexico - but if you are visiting India - then oh well - India is just as fine.
Easier to get appt in Mexico/canada than in India. I have heard.

I am in the same situation as you. I came as a student then moved to OPT and then H1B. I am now going to India and I was planning to get my H1B stamped in my passport.

I was wondering if it is no trouble to you if you could post your experience.

I am also currently in the last stage of green card application. I have my I485 filed and have an approved Advanced Parole & Employment Authorization Document.

221g --- VISA on hold

Hi all,
I am in the same boat too.
My Visa is still pending.
I have had 2 interviews :
The 1st was on 12/5/2003 when I was asked to submit a whole list of docs like W2s of all employess. tax returns of my employer for past 3 years, photographs of the company I work for and so on..
Then 2nd was on 12/19/2003 when I submitted all the docs to them(my employer was kind enuf to take the trouble to promptly send all the docs to me in a sealed box!). The consular officer
examined all the docs and told me that they would need to do some internal administrative processing and they wuld get back to me.
It's been nearly 3 months now and In haven't heard from them.
I call them every week and I keep hearing the same response that they will get back to me.
I have no idea if my case has even gone further or is it just lying there.
I don't know what to do?
Do I have any other options?
Has any one got their VISA stamped after going thru 221g process and if so how long does it take.
Please help!
