If I were the IO, I would have done the exact same thing. I don't understand why every other sentence in your post is followed by a " lol" !!! Is it the fact that you were in a great mood at the intreview or you just think that the entire world revolves around you and the IO would see how cute you are and grant you your wish? No wonder you were treated that way because that's exactly how you presented your case. Mr, " lol"...

Just 4 pictures, seriously? Walmart and Walgreens charge around 7 cents for a picture (to turn soft copy into hard copy)- Dude it wouldn't hurt to spend a buck or two for gathering proofs.

You are 24 and you've been to court for various reasons - quite amazing!

Your crimes and this post do make you sound reckless and somewhat immature. I can understand the immigration officer's actions.

You just need to do exactly what he has told you to do. Get all the details of your records that you are able to from the courts. Be honest !!!
The tax, employment and marriage proof should be easy to do.

Hi all,

Well today was the big day my wife and I had the first interview. Sad to say it was 50 good news and 50 bad news lol.
The interview started with aos officer doing the oath and asking us questions. When he got to the criminal question he was a little rude but maybe it was him testing our attitude and seeing if we are violent or outspoken individuals. (your input will help no relief some doubt) I had traffic violation with Failure to appear but i did show up after and paid my fines and had one public intoxication. But it was my 21st birthday and got a little out of hand. So when he saw the counts he was mean and yelled stating what the hell is wrong with me and causing all this crimes. I was like wow are you serious 2 of them were just FTA because I didn’t have the money and then paid. And the public intoxication its your 21 your only 21 once you know. Ok well we didn’t say anything but he did scare the f out us. For the record I am only 24 and my wife is 23 sweet all American girl who wouldn’t hurt a fly and I am the clean cut express cloths wearer. So it came to a shock to be called a criminal LOL I know it’s serious thing handing out a Green card but we didn’t see why he had to yell and hit his own desk.
Ok enough so that ended with we will need court dispositions of all counts.

Then he moved onto the I 130 wife part and he was very frustrated because he didn’t have tons of wedding pictures and her most current w-2 for 2009.

One we explained that most pictures we have are digitally stored and parents having the other half and we have a real hard problem getting a hold of our parents. And the 2009 taxes well we haven’t even done so yeah. He look at my USC wife and said are you serious do you know what benefits I can bestow on you!
She was like wow but no facial expressions and we both looked at each other wondering oh man were screwed.

Well after all that he moved on asking how I entered the US and if I got my EAD and so on. After 30 minutes of asking paperwork question he said I am not going to go any further with your case and want to let you know that I have to go through USCIS guidelines for criminal activity and figure out if you’re a danger or are a criminal. So I cannot make a decision at this time. (while waving a big fat black INS LAW book) At the end of his sentence he slammed it on the desk. He took our banks statements wedding picture and passports and ID’s.

He left for 15 minutes.

At this time we realized wow we should have printed out the wedding pictures more than 4 lol and finally realized that the FTA infraction tickets qualify as criminal and not as an infraction so we needed the disposition so now we know and for you guys reading learn from our mistakes. We also realized that were young and not even 1 year married but been together for 2years and maybe the AOS officer was showing us that the process of becoming a permanent resident is a serious process and no joke. Which we knew even before we got there.

So AOS officer comes back with a complete different attitude and explained in a calm tone voice that we need to fulfill more requirements and that I have to deal with my crime record so he can make a decision. He printed out a document which was itemized with document he wanted from us.
W-2’s for 2009
Pay stubs
Employer pay rate
Court dispositions
Proof of a bonafide marriage.(wanted more than certificate and pictures and bank statement) he wants activity of shared property of bills. So I suggest everyone to make everything joint cars credit cards and bank statement. Also want picture of property owned. So weird!

Asked us if we had questions we asked some he smiled at us shaking his head stood up and wished us well and a good day reminding us we have only 30 days to get this done. Ouch!

So now what? What can happened after we submit all t his paperwork he requested. This time we are going to overwhelm him with tons of pictures and so on.

If we submit all this info and is up to par will he issue another interview or can he make his decision based on the documents he has now?

UPDATE
1. Note we went to court and one of the counts was expunged no records were found and was stated on the disposition certified letter
2. The other was cleared as in I paid the fine and showed up to court
3. The other was a turndown from the DA no records found as well.
4. The last public intoxication looks bad saying that I didn’t want to go to jail and made a scene which being older and more mature accept the consequences of my actions and did go to court as scheduled on time and plead guilty and paid fine.

We also know you cant give legal advise but can you guys give us an example if what happened in your similar case to us?

Well it turns out I got news today that the courts have dismissed all the FTA’s and have no records do to Government Code 681.52. So there is no disposition the court can give out except a certified letter stating that they cannot find records do to that code.

Also I want to take this opportunity to acknowledge that I have read all your inputs and I have to apologize for the way I typed the first post I was a little mad, depressed, worried and so on. Just like anyone I am human and cope with emotions differently. So I am sorry for my typing.

Now that this is out of the way we can get to figuring out what I may need or not need.

I understand that it’s a privilege not a right to be here. I am certainly not demanding just requesting for conditional status I know I am still young and have ways to go. The reason I feel that that I want conditional is to show the USCIS that I have changed and have lived a good moral life after learning from my hic ups in life and only then they can review me again and if they feel is right they can give me my Green Card for 10years.

As for my Statement your only 21 once is because I took what an officer told me when I was released from the PD and the good news about that. Is that the charges were never filed because the officer believed your only 21 once. I understand the law is the law no matter what and we have to follow it and I had the power to tell my friends NO! I don’t want to drink, but I decided otherwise and now I am paying for the consequences of my actions.

One more thing the use of words like: LOL and like is do to the fact that I typed it after a busy day of running around and was typed at 1am. So I apologize again for the poor grammar.

Now that everything is explained what do you the members of this forum think of the IO actions of slamming the table an act to see if I am a violent person or test my attitude?

As for the pictures we only came with 4 because we sent them over 50 pictures on our original package with statements for the past 2 years that show our expenses and joint activity. Marriage license original letters from CEO’s and CFO’s stating that we are good individuals and knowingly know that we are married. I also had a letter of recommendation by the assistant director of the DHS from 2006 saying I am not a threat to the United States. The only reason I had this was the AD of DHS is a child hood friend of my mother in law. But even then the IO just glanced at it with a weird look.

It is important to note that we did not come with so much paperwork because the appointment letter strictly stated to come with documents unless already submitted. And we have already submitted all original documents. So we figured we didn’t have to bring repeated documents. I do have to admit that we did drop the ball on not preparing our 2009 taxes earlier so we could have that info ready and my wife dropped the ball on not asking her employer to hurry up with the verification of pay letter the USCIS wanted.

With all this new information that you have been given do you believe we will be scheduled for a stokes interview?

Or do they just want to make sure that I have court explanations of my alleged crimes (FTA have been removed) and that my wife has the means to support me(her 09 w-2 is 60K)?

As for bonafide marriage we are sending them 100 pictures this time of both parents with us, pictures of us being ourselves with friends and pictures of our home to show them our inner workings of our life.

I read on other post and took notes on what other people have sent.

Yet again thank you for taking the time to read my post.
 
I don't have answers to most of your questions... but just a few observations....
It is important to note that we did not come with so much paperwork because the appointment letter strictly stated to come with documents unless already submitted. The IL doesn't say so. The docs that you don't need to bring unless already submitted are clearly specified. About evidence for bonafide marriage, the IL does not put any limits or tell you anything about earlier submissions.
I do have to admit that we did drop the ball on... I hope you have learned that "dropping the ball" often is not an option especially with USCIS.
 
Letter from CEO and CFO--you must be a big shot!

Don't worry they will let you know if they need additional document else you will get the approval in few weeks. Keep checking the online status of your application on their website.

I'm not surprised. It's just a scare tactic.

50 photos should have been more than enough.
The letters are from people who probably don't know you well.
They should be from neighbours who can attest to seeing you together almost everyday, friends who you hang out with together, ministers etc..

It sounds like it to me. Dunno though.
Perhaps if you just send them everything they have asked for then you can avoid that.

Probably.

As for bonafide marriage we are sending them 100 pictures this time of both parents with us, pictures of us being ourselves with friends and pictures of our home to show them our inner workings of our life.

The letters are from the CFO and EVP who happens to be my ex mother in law, and the CEO is a close friend who we hang out with all the time. So they both know us very well.

But yeah I will keep you updated on my case.

As far the stokes interview I read around and it seems to me that it’s not as bad as it seems. They just separate you to make sure you are not lying and we both know each other well enough to be husband and wife. So in reality I am not to scared for the interview if we even get one. If anything we will be more scared waiting for approval and or denial letter after that.

Ok so I got my work permit and card production ordered on may 22.

Hope this helps other with a similar situation as mine.
