Let me ask you this question and i am sure someone might have already asked this earlier.

My wife is currently on H4 and have recently got a job and got her H1b approved. We have to get her h1 stamped before she starts working.

Does she need to go outside of US to get her h1b stamped. If so , Mexico or Canada .. which is better.

If she has not had any H1 Stamping from the home country, she may have to get the stamping from Home country. This is just my findings, Wait and see other's responses too and decide.

She can go Canada/Mexico or home country.

Check threads for Canada and Mexico regarding visa revalidation and you will get details.

If she did not receive an I-94 as a part of I-797 the h1 approval notice she needs to go to a US consulate for a visa. If she has received I-797 with an I-94 attached indicating H1 status, a visa stamp is NOT required to begin employment.

Unless the rules have changed, I do not believe that you need to get a stamp for starting work under the newly approved H1.

simple enough
if H1 was approved with I-94 then she can start working ..Next time when she leaves US she will need to get a stamp.

if H1 was not approved with I-94 then she will have to leave US to get the H1 stamp. I am not sure thoguh whether her previous H4 status is still valid or not in this case. meaning she can continue to live here on H4 and then whenever she decides to go out of US she can apply for stamp
