First H1B stamping (H4->H1) in Mumbai

Going to India next month. Currently have H4 stamp in the passport. SO, I will be getting my first H1B stamp while in India.
My labor is filed in NJ.

I have the following question -

There is a question on the visa application form (DS156)
Has anyone ever filed a immigrant petition on your behalf?

What should I be answering for this question ?? YES? or NO?

Since H1b is a non-immigrant status; do you think there will be a problem to obtain my first H1B stamp if I say that my GC is filed?

Anyone with any thoughts or experience; please reply.

Also, how soon can you obtain interview appointment at the Mumbai Consulate? I will be going to India for 3 weeks - so I have to make sure I get a H1B stamp since I only have a expired H4 in my passport currently.

---- NO , becase I-140 is immigration petition and LC is NOT immigration petition

----- you will know once you apply becase Idont have recent updates from Mumbai Consulate, you can visit US mumbai consulate site

**** Be prepared for Vsa Stamping delay at this time Bombay consulate is creating problems for H1 or H4 Visa stamps( nothing to scare you)

Hello,
I have got my 7th year extension approved and my family (H4) is traveling to India and I (H1B holder) am not. I want to get my families passport stamped in Mumbai, I have all the appropriate documents avaialble but one of the document required is copy of H1B visa holder. In my case I have visa which has expired on 7th April, but I do have notice of approval till May 2005. As my family is stamping H4 visa in India before my visa revalidation here in US sometime later this year for the new period of extension, will this situation will create any problem? Will my family get visa for extension before I get valid visa extended on my passport? My family has notice of action for H4 visa valid till May 2005.
Any help is highly appreciated.

Hope you had a smooth procedings in your visa stamping.

I am in a similar situation as yours, only exception being, I am on F1 and will be going to india for H1 stamping to Mumbai Consulate. My immigration petetion has also been filed. I would really appreciate if you could let me know your experience. and also about the question on the Visa application form.

Had you scheduled you appointmen online or in person? please advice about the documents need for the same.

your response will be highly appreciated.
