first administrative processing was expired !

Hi Folks

I have a question, I hope I get some answer and help here
My Wife is living in USA and she applied for I-130 at 2001

After 6 Years the case get approved by NVC at 2006 :D and sent over to US Consulate at Frankfort – Germany

The consulate contacted me and they told me this will take time till we schedule for your interview due to Administrative process

Jun 2007 I got my Interview Appointment and I went there and submitted all the required papers and medical …etc

They told me we will let you know when you need to send us your passport so we can issue the Visa

And this may take maximum to 4 weeks

Today I contacted them and they told me Sorry Due to:

First administrative processing was expired we had to renew it, it may take between several weeks to several months

Do you know what that is? Dos that include again FBI name checking, because if it includes another FBI name checking it may take another 7 years …. Or it is just department state check and it is better ?

Or dos it mean My Wife need to re-submit again Finicial support and tones of forms to NVC again ?

Having this case for almost 7.5 years till now is explainable and absolutely OK with me because I came from middle east background although German as citizen, but I do respect the rules to check and make sure that idiots and terrorist are not taking advantage of the system, and US need to check for sake of security but on the other hand if my first administrative processing expired and need renew and will take another 7.5 ( 14 year in Total ) years!! It means half of my family life spends between waiting and hopeless

is your wife a US citizen and has she been a US citizen all 7 years? if not, then it's not an administrative check that took 7 years, it's just waiting for a visa quota. Your administrative check may take days, months or years, independently of how long your petition was pending.

NVC doesn't approve applications, USCIS does.

No ( my wife ) she is permanent lawful residence , and she is still ( she is waiting for FBI name checking on her N400 since 4 years and two months (50 months ) and you are right the main waiting time was from USCIS back that time called INS

After she submitted I-130 2001 to USCIS and after 5 years she got the letter from NVC (that the I-130 ) approved and then she had to submit additional forms to NVC.

NVC took one year to proceed and then NVC sent it to US . Consulate in Frankfort Germany Dec.2005

Dec.2005 I got a letter from US consulate in Frankfort Germany , that they received my case from NVC and I have to wait for security check and administrative process and then they will send me an appointment for interview , Waiting for Visa Numbers was not in my case because by the time US consulate got the case from NVC they were working and issuing visa to cases for 18 later and newer than my date…

After 1 Year and 6 month the consulate seems that they finished the administrative process and they sent me appointment for interview , which was last month Jul-2007

The interview done without problem and everything seems to be OK
And I was expecting in 4 days to maximum 4 weeks to have the Visa issues
Now they said :
“Since the first administrative processing was expired we had to renew it - our office started it on June 29, 2007 and we are waiting for the result , it may take from several weeks to several months “

My question :
Based on the dates and history of the application , do you thing the Name checking has been done before ? Do you thing they have to re-do the name checking again ? What is the first administrative processing was expired we had to renew it ?
Is it renwing whole the thing starting from USCIS ? Or starting from NVC or Name checking ?

I am not sure about administrative processings, but I was mad when I read that your wife is waiting for so long...

Please take it seriously... I was waiting hopeless for my husbands naturalization, till I found that thread... We sued and won... My husband was naturalized within 4 months of filing a lawsuit.... Now I can adjust status much easier....
Why not give it a shot? Plus, doing something might give you a better feeling than hopeless...
