I am married to an American citizen. I filed I-130/I-485 on 9/04/03 and received the notices on 10/24/03. In the notice, it asks me to call and schedule a fingerprint and biometrics at ASC, I called and was told that it looked that all were booked by the end of this year at the local ACS:( . I have several questions:

1. Can I schedule an appointment at different ASC if it's earlier? Anyone has done that?

2. After the fingerprint taken, how long does it take to get an interview

3. When will the security checking start and how long it takes, after the interview or the fingerprint? (Texas center)

4. I looked at the processing time at Texas, it shows that

I-130 Spouse, Parent or Child under 21 of US Citizen 6/18/2001
I-485 Application to Register Permanent Residence or to Adjust Status 1/23/2001

Does that mean that I have to wait till my receipt date in order to get processed(interview or approved)?

5. I am currently employeed with H-1B visa and I did not file for EDA, should I do so before my H1 expired?

No you are not advised to do that.

Texas is pretty late in all these things. Did you apply local service center and where ?

3. When will the security checking start and how long it takes, after the interview or the fingerprint? (Texas center)
It depends. Some do it before and some after the interview.. No fixed pattern.

YES..

You should if you want to change employers... EAD will make easy...

I just called the ASC center and scheduled an appointment at Alexandria, VA this Friday, the local ASC center I am suppose to go does not have any availability until Jan 4.

No you are not advised to do that.>>

This is the second time I called in two weeks. First time I called, a gentlement told me that I could schedule at different ASC. This time, a lady told me that she was not aware of that, but later, she scheduled it for me anyway, not sure if this will work. I'll give it a try. Hope it won't mess up the process. :confused:

Charlotte, NC. My receipt was from Lee's Summit, MO though.

YES..>>

Well, I am really confused with the whole process. One of my friend told me that her friend applied for greencard through marriage base(citizen) in June, 2002(same city I live), and got approved and stamped within 6 month.

I guess it's case by case?

If you filed to adjust status based on Marriage to an American Citizen and have sent the papers to your local district office they should schedule you for an interview anytime from 6 months to 2 years.

This is Chalotte's processing timeframe:

Permanent Residence - Adjustment of Status

Filing Until Approval (With Interview) 345 - 400 Days

Work Permit ("Employment Authorization Document") 70 - 100 Days

Travel Permit ("Advanced Parole") 70 - 90 Days

HTH and o btw it's in your best interest to get an EAD card (which gives you the liberty to work for any employer)

As for the ASC issue.. You can get your prints taken at any ASC office in the United States provided you have your Alien Registration Number or INS fee filing reciept available with you.

Update for my fingerprint:

I went to the ASC in Alexandria, VA today, it took me about 20 min to get everything done. I was surprised that there were only a few people there and I actually took my fingerprint before the scheduled time(the girl told me it did not matter).

Does everyone know how long it take for the background checking by FBI?

were you fingerPrinted on a bio-metric machine?? The computerized one I meant?? and if the ASC lady gave you the copy with a stamp on it.. your prints have been cleared from the FBI.. if they asked you to come again it means there is a problem.

Yes, It was done by a biometric and I received a stamp on it and I was also taken a photo.

Does that mean that I was already cleared by the FBI, therefore, the next step is to wait for the interview? I am little concerned that I got my fingerprint in Alexandria VA other than the local ASC in Charlotte NC, will they send the result to the local office(Charlotte NC)? I heard stories that fingerprint results were not transfer to the right application center.

yes your prints have cleared and they will be sent to your local district office.

and this means that all you need now is an Interview.. Fingerprints is usually the last step before an Interview

Thanks for your prompt response.

If it's been cleared by FBI, how do I know? will it show in my online status(how long)? I heard someone said that he had fingerprint done last weekend and he saw it got updated in his I-485 status online.

What about security checking?

I checked my I-130 status, it says it will be taking 30~90 days
for I-485 it will be taking 120~180 days.

I hope they can be done within the timeline though I heard so many depressing stories.
 
The stamp on ur fingerprint form is a confirmation that they have been cleared from the FBI..

I donot have a time line for the background checks and the I130 / I485 processing times.. you have to wait and watch.

Even though the FP was done on computer and the lady gave a stamped copy, that has nothing to do with FBI approval. All that means that the FP wont be rejected for unclear prints which is a possibility in manual process. They still have to go to FBI for the check... Normally the approval from FBI only takes a few days...

One more question.

If my fingerprints are cleared by FBI, where will it be sent?

Charlotte, NC where I applied or MSC where the applications are currently being processed?

Oh really?? I didn't know that .. when i got my prints done a while back the ASC guy told me you are cleared from the FBI right then and there.. maybe its a different process at different ASC's?? no idea but thanks for the info bud.
