I am the primary applicant. Mine and my wife's case approved on 3rd Dec, 2004. We got the passport stamed and have received the plastic cards also. We did not receive the approval for any of 2 daughters. Then we contaced INS and senator's office. Then younger daughter's case was approved on 3rd March, 2005 and we are struggling to get the approval for elder daughter. In fact she requires the green card in next 3 months to apply for medical school.

When we contact INS and attorney contacts INS, they do ask for my A# (primary's A#). I guess they have been able to link the case. We have received some replies that the case is in I-485 area. Then that it is with 485 supervisor. This was about 2 weeks ago.

We can visit immigration distirct office (I suppose Atlanta for us), but they may say that the case is with TSC not with us. Do you know what is difference between District office and local office. We live in Birmingham Alabama.

We sent the police clearance to our attorney and she has sent the same to TSC 2 times. At this time, a research specialist attorney from our attorney's firm is helping us on this. But she also has been trying for 2 months now and have been giving us regualr feedback of her communication and discussion with INS. Congressman's office tells that we are following this case very diligently.

I have moved around a lot for the past 5 years. However, I always live in the same county. Do I have to have all the addresses I have lived with me?

:eek: Actually it didn't take that long. After that notice, we received approval notice a week after that.

I am not sure about county office though. You may have to go to each City Police Departments. :cool:
 
District/Local Office

I think there is no diff between Local and District office - They are the same thing. For you - it is the one in Alabama (MLK Jr. Federal Building).

Yeah, you're right! :( they may say it is TSC case, not theirs. But sometimes if we are lucky we get a very nice officer and he/she will help.

Make an appt through infopass "You wish to speak to an Immigration Officer" -You will lose your time, but you may meet an officer who can help you further. You know - There is always a miracle, but we just need to work a little bit to find it ;)

When I could not do my 3rd FP at ASC, I was worried and did not know what was next. I asked my lawyer if I should send Police Clearance - but laywer said "no use - because no RFE from TSC". When Service Center sends RFE, they will attach a form that we need to send along with the response. I was quite frustrated, and thought "Here we go - wait another seven year!" So I went to see District Officer with no hope that they would help me. Waited for about an hour, and finally got an officer. She gave me a kinda cold response, but she actually inquired on my case and told me that TSC would send me RFE and sent me home with nothing. About 2 weeks later, my lawyer told me TSC sent me RFE for Police Clearance. I got that PC letter and FEDEXed to my lawyer on the same day. My lawyer sent that letter along with orange form TSC sent with RFE letter.

Just give a try...I wish you the best. Hopefully your daughter will receive hers before the time for Medical School.

The catch is whatever places you have listed in G325A form and anywhere else in the application for the past 5 yrs residence, you will need to get Police clearance from that city. I got mine in an hour but may vary with cities. Hope this helps.
 
2004_GC,

The past 5 years is counted from RFE date or the date I filed 485? Because I lived in another state 5 years ago.

Also, on the RFE form, it lists the state police address, I just wonder if I just use my county police's clearance.

When I485 is filed. Take a look at the G325A form where you stated various addresses for the past 5 yrs. These are the places you should get police clearnace from. They need the Police clearance from the cities you have stayed and not state. counties may not work either...get from cities you have stayed at least for the US.
 
Police Clearance

We have lived only in one city in last 5 years i.e. Hoover in Alabama. When we went to take police clearance from City Police, they told us that police clearance for the immigration is given by State and there is no procedure take the clearance from City. Hence we took clearance from State in Nov, 2004. But USCIS is just sitting on our case.

It sounds like it varies with cities/states.

BTW, I have a good news to share. My spouse 485 has been approved today. No interviews or so!!

From the sample police clearance notice (for naturalization) I saw on the web, they only need police clearances in the United States. Does the RFE ask for clearances from foreign countries too? :(

Yes if you have stayed more than 6 months in that place and is listed in your G325A form.
 
Has any one received approval for 2 FP rejected cases

Has any one received approval or any other progress where FP was rejected twice due to poor quality
 
How long it takes to get police clearance from the state? It has been two weeks and I have not heard anything from them.
 
How long State Police

we wnt there personally and they gave us within 1 hour. Make sure you get notorized the police report there itself.
 
Case transfered to Atlanata.

The case was transfered to Atlanta on 7/8/5.

ND is 6/26/05. Any idea how much time it will take for the interview.

Yes, we have received approval after FP being rejected twice. No interview took place in our case.

Good to see progress on your daughter's case. Not sure of interview timeframe...guess it works on the basis of how busy your ASC is? Good Luck!!
 
Interview?

Do they update the USCIS site when they send the interview?

Do they send an e-mail after scheduling the Interview?
