Yes, that was the main purpose for the Congress to pass AC21 law. To get rid of the employer's control on the I-485 applicants, in Other words, the Slavery.

But our USCIS made lot of conflicting memos and nullified the good intention of the AC21 law.

Hopefully they will now issue new memo to help all of us.

You may be right here. Probably that explains why there were more than 10 LUD changes on 140 and 3 on 485 within a month time.

This also gives me hope that 485 updates are actually not a bad sign as now many people are reporting on this forum that 485 LUD are also happening with 140 LUD.

Actually, none of the attorney agreed to do my case and I have been doing it all myself including reply to RFE without getting the RFE in hand.

I have taken the same plea that after 180 days, I am eligible for AC21 and by not doing that, USCIS would be encouraging the exploitation by the employers.

Never the less, if my case gets approved in light of this new possible ruling, it would be a big relief and victory for me. I would offer you a treat in the Bay area CA, and if you do not live here, I would invite you here and bear all expenses for that. After all, you have been supporting it for a longtime and helping me in maintaining my calm.

I don't think your case is a Test case. Till 240 days, your I-140/I-485 were pending. After that only your I-140 was withdrawn. So You crossed 180 days and still covered by AC21. May be that is the reason why USCIS doing all kind of R&D with your case till now.

If this new memo comes, you are going to get approved without any doubt, buddy. Believe me.

(my case is almost same as you, except my previous employer replied to RFE, not withdrew the case)

You are making me feel relaxed and happy. There is a memo by Murthy also, which is on one of the threads on his forum, that after 180 days, 140 approval or disapproval probably means nothing as AC21 would overrule that. I do not know when the ruling will come but it gives me hope that probably, something is cooking at USCIS internally and that could be reason for so much R&D on my case.

It is also possible that the case has been discussed in details internally as the LUD had been changed almost 10 times in a month and something favorable may happen..although I still feel it as a slim chance.

I am not sure what would happen to my case but I have already planned that if the case is denied, atleast I have now some ground to appeal.

If it is approved, well, we will celebrate.

And I stand on my words...no matter if you are at east coast...you would still be invited to bay area for an all paid trip...to celebrate...on my behalf..and I am serious about it...No kidding here... :cool: :cool:

One quick question. Your I-485 LUD changed on July 27 and 28. Right? Did your spouse I-485 (Hope you are not a single) LUD also change on July 27 and 28?

Yes, LUD changed for my spouse as well. On 6/24 also, it was changed for me and spouse both.

However, in all above cases, it did not change for my child. It is still reading the old one e.g. 10/21/2003.

Do you have any point here?

I am just trying learn from this LUD changes. I feel if it is a RFE for I-485, then most probably only primay's LUD will change (Unless there is a seperate RFE for spouse regarding marriage certificate, birth certificate etc)

If both LUD changes, then most likely it will be an approval. ( Or in worst case denial)

I read thru this whole thread only today .... though i have seen ur name in forums in quiet a few places and i am kinda new to this portal ..... My prof goes like [140/485 ND 05/2003 and 140 - AD 04/2004 / EB3 / 2 EADs 2APs until / FP on 03/2004 - which kicked of my last LUD 04/05/2004 .... Thanks...]

Your case is ofcourse a GC_Peculiarcase ... and I suppose and wish your case becoming GC_Successcase. Anyway, seems like nanshi is a damn good supporter .... Best of Luck !

Never the less I am fighting at my own. naanshi has been very good supporter. I was wishing naanshi to be here in Bay Area this labor day for a treat but looks like, it is going to elude for some time.

after a serial curiosity, my LUD changed today to 09/01/2004 and which is not of any exciting reason for sure since I know that I did change of address and called 'em last week ....

Labor weekend is over. No progress on the case yet. Last LUD 7/28/2004. No FP notice even. Did you get yours?

I could not connect with immigration officer yet. I will try that tomorrow again.

One of my friend told me to check about my address with USCIS. I sent AR11 application last year in Sept and also sent letters for 485 change. I was told by attorney that address was changed. I am not sure.

If the letter goes to old address, will it be forwarded to me? I have given my new address to post office and getting the letters forwarded to my new address for last one year. I am not sure how it works in case of USCIS notices.

Check your address with USCIS immediately. Normally finger print notice goes to the applicant and the courtesy copy will go to the Attorney. Check with your attorney(I guess, it is your old company attorney) whether he has received or not?

If the letter goes to the old address, normally USPS won't forward it to your new address. Better call USCIS and find out what is going on in your case. Try to talk to an Immigration Officer, not the customer support rep.

By the way, I completed my FP in April 2004.
