Finally know what was asked in RFE

After waiting for almost 2 weeks, I heard from my lawyer that they have received the RFE which was mailed to them on 4/4 (per AVM).
The RFE is for the following three things

    1. Last 2 months payslips
    2. Copies of my entire passport.
    3. Letter from Employer

Now, get a load of this. My attorney had the nerve to tell me that they are not going to file the response until next month. Reason, they are busy with lot of other cases. I have been paying top dollars for this attorney from my own pocket. It has been over 5 years for this entire ordeal. They have chardged me over 4 grand (plus the cost for ad in newspaper).

I have to deal with two evils here INS and Lawyers.

I am just wondering if I could file the response myself. Can someone help?

I am definitely looking at some other lawyers who can help. I have all my documents from H1 till this stage with this lawyer. I hope they don\'t cause any problems if I ask them to transfer all the papers to someone else (or myself).

Hi,

I am glad to hear that your RFE finally came thru...for a while I was worried as to what happened...

The problem with sending the response yourself is...you need the original RFE since it has a barcode, which VSC needs...so that they can send that response to where it needs to go...

If you have that, and any other documents (maybe a barcoded envelope?) that need to be sent back along with the RFE, I guess you can send it yourself...

But, in any event, it is really sad to hear the lawyer say this...I can\'t believe he/she said that...

Is your lawyer from the NY/NJ area?

Why they are asking for your Passport all copies? When you file , did you send only the pages which has some mark or stamp on it?

Yes my lawyer is from NY and has no time to talk to the clients. It is almost like they are doing you a favour by filing for you, even though you pay them each time they have to do something. My RFE letter has a notice date of 4/4/01 and my lawyers said they received it yesterday. I am not buying their story.

Anyways, I would need the original notice in order to send response to INS.

I am also suprised by the request for passport copies. The notice says
"Please submit a legible photocopy of the personal data pages of , the visa on which he/she last entered the UNited States, and the latest United States admission stamp in his/her passport"

So I guess the copies I had sent originally, were probaboly not clear.

Your lawyer must be very busy with the 245(i) deadline for Apr30th!!!
He must be making tons of cash on that so that is why he does not care
about you.

You can do it yourself. I paid same thing to my lawyer, but I done everything myself. He only made trouble to me, If I do my GC myself at beginning, I believe that I got it already.

Mera_Kya_Hoga, I think your lawyer sat on it for a week. I was notified by my company today 4/18 that the lawyer received an RFE about my kids birth certificates with parents name on it. The AVM said it was issued 4/9/01.

Did you speak to the Lawyer/paralegal/receptionist ? Sometimes, the paralegal/receptionist are a pain. And never put you to to lawyer. I think you should still get hold of the lawyer / take all the documents and go the the office directly. And tell them that you will courier it yourself and you just needed some documents that was with them (bar code / so). However big your lawyer is when the client comes in person - They do meet/help in some way.

I think you should go to your attorneys office yourself with all the necessary documents as per the RFE and tell them that you will mail it by yourself. Sure you can go with an other attorney. But since you mentioned that all of your papers are with them, why risk it at this stage after waiting for such a long time. You should forcefully mention the fact that you have been waiting since 1996 and want this to be done with. I think you should go to their office in PERSON and make sure that they mail the response.

AVM said RFE on 4/9/01 and Lawyer received it on 4/11/01. I had to redo medicals. Sent it to Lawyer on 4/16/01 and lawyer sent it out on 4/17/01. I think your lawyer just sat on the papers till now.

It is the time. You go ahead and reply the query. Dont wait and waste time for that lawyer.
Actually they dont do anything. Through this board we know a lot than those idiots.Just show up...
My case was approved on April 12th. When I called my lawyer on April16th they say INS still working
on October cases. It takes atleast 2 or 3 months in my case...
I did nt tell them that my case got approved. Just hang up got irritated. This law office declares itself as immigration specalist

Though it is legally possible to retain another lawayer at any stage.. it will slow down...I think the lawyer we are retaining would have to then get all papers from original attorney and file with a new G325 form. Best bet is to call your original attorney and aske them to expedite...may be that guy is expecting some extra dollar for this...

I thank you all for your valuable input. As you guys have mentioned it correctly, I\'ve hardly ever talked to the lawyer himself. Most of the time, it was their secratary (who now herself files cases), who have acted rudely and show no compassion and urgency for my case. It must be routine for them, for they do it day in and day out. I agree that thanks to this board, we know much more than them.

I am planning to call my attorney (not the secratry) and ask him to expedite my case. If I can\'t get throught to him today by phone, fax or email, I intend to go to their office in person tomorrow alongwith all the paperwork that is required for RFE response.

Having almost a sleepless night, I am feeling much better after reading the overwhelming response from you guys. I don\'t know how to say this, but your concerns and compassion gives my morale tremendous boost and I feel that I can handle it much better now. Isn\'t it amazing how us strangers on this board are so close (dan dan and some others remembered that I am waiting for RFE for example) and people who are paid like my lawyers show no compassion at all.
