Finally...June 2002 case approved..just got the email

If your I-140 is not approved then the problem comes.

AC-21 says your approved I-140 and pending 485 more then 180days you can change your employer.

I-140 is employers so if I-140 not approved don't think to leave the company. If your employer want to cancel your pending application they are free to do at this situation.

Employer has control if I-140 is not approved even after 6 months of I-485.
Employer has no control if I-140 is approved and 6 months old I-485 time.

That means a big company (like mine) lays off, it will deprive me of my GC process also ?

I think the CIS is unfair here. After waiting for 2 year labor processing, irrespective of I-140 approval, if the I-485/I-140 is > 6 months, then the GC petetioners should get benifit.

There is no new rule like AC-21 for now, even if you file your 485 and passed 180days but not approved 140 then you are in trouble....that is disadvantage for the concurrent filers.

If you compare with the old filers it is very bad on the new part. Now a days people from couple of Service Centers they are getting approvals in 1year after filing 140 and 485. That means you are not loosing any thing. If you file 140 seperate it will take min 6 months and after that you have to wait 8 more months with the sponcering employer (total: 1 Year).

For concurrent they are getting approvals in year means they are working some thing good for the new filers.

Old filers who filed their 140 waited 6months to 1 year and then again filed 485 waited 6months (to change employer if they dare to do) to 3 years for only 485.

For all these thing there is + and -, we have to adopt it.
