Finally...June 2002 case approved..just got the email

My wife approved on Nov 1st
Self approved on Nov 3rd


Started this journey in March 2001 when my I-140 was filed.
Filed I-485 on June 26th, 2002.
Changed my employer in April 2003..

Sent an AC21 letter to USCIS informing about my changing employer
Sent couple of faxes in 2004 for FP..nothing happened..
Contacted congressman for FP in July 2004
Received 1st FP notice in August 2004
Did early FP in September 2004(One month earlier than scheduled)

Filed for 3rd EAD in September 2004 and sent another EVL alongwith it..

Now the approval..

My Advise
---------

- Do not sit idle. Do something (contact ur senator/congressman etc. if your case is not moving)
- Always inform USCIS you are using AC21
(In my case it helped because my previous employer tried to revoke my I-140 but USCIS refused..)

jpsul,tanjar - My LUD never changed after June 2004(That was the the time when I changed my attorney)..FP was issued in August 2004..I did my FP in Sept 2004..Again no change in LUD...LUD changed today only after approval..

PS today

I and my wife did passport stamping today (Nov 10th, 2004)..

Took INFOPASS appointment, Submitted passport with I-94, two photos and courtesy copy of approval notices ..That's it..Passports were stamped within 20 mins after finger printing of our index fingers..

I had all the EADs and APs but did not submit anything and the officer at USCIS never asked for those..So.. :D
 
Jack1, Congratulations. It is interesting to know that USCIS refused
to withdraw the I140 petition.

From my source with old employer I know that my old employer tried to revoke my I-140..They also sent me an official email..but TSC informed them that I-140 can not be revoked since my I-485 has been pending for more than 180 days(270 days that time)..

In such a scenario TSC would issue an RFE requesting for employment verification which I pre-empted by sending a letter to TSC from my new employer soon after I joined...

As a result there was no RFE for me or my wife.. :)
 
I am seeing a lot of people requesting sample letter formats for congressman/senator, INS FP request and FBI name check status request..

I know it may look like a dumb question for veterans. But I need some clarification if you or others can. What was the criteria (if you know) for CIS to refuse revocation. Is it your approved I-140 and 180 days > for your I-485 petetion and successfully changing your job.
Can an employer revoke if I-140 is not approved though I-140, I-485 is > 180 days ?

I request this info because of retrogression (priority dates) coming into picture, there are so many like me waiting for an year or more w/o approval of I-140 and I-485.

What is the exact control of an employer on an I-140 petetion ?
