Hi every one.

Our case is fially approved by Cleveland office. I got stamped by attorny copy. Stamping experience was very good. Officer at infpoass counter him self stampped both pps and realesed us wthin five minutes.

Case detail: Case- 245(i) LIFE ACT type,

LC was filed on or around March 30, 2001.

I 485 ND: Nov. 2002. ............ AD: 22 April 2005.

Total 4 years and 1 month .

IS IT REAL END ? OR JUST A BIGINING ( CITIZENSHIP ) ?
 
How did you handle the 245i ?

I have a question regarding 245i, I recently got a RFE for my and my wife's i-485 cases, one specific RFE is to prove my wife's legal status. however, there was a 38-day gap between her OPT expiration date and H1b approval date (although H1b receipt date was before her OPT expiration date), but my wife did not stop working during this 38-day period. I have been told that my wife should be fine since it is less than 180 days so her 485 can still be approved under 245(i), my question is:

What forms do I need to fill out to claim the 245(i), or just writing a statement mentioning 245i (with $1000) will be enough?

Oficer simply asked me detail that was filled I-485 , one by one he was asking and was matching my reply with form filled, that's it. Nothing more.

I think it's 245(k) not (i). And you don't have to pay 1000 for 245(k). Check with your attorney.
 
It is 245i.(for being out of satus) and you need to file suplement A with your I485 to claim the benefit. You need to submit evidence of eligible "grandfathering" petition (like LC) and depending on the time you became eligible you may have to submit evidence that you (your wife) were present in USA on Dec 21, 2000.

245 (k) covers being out of status for less then 180 days. And caiyw001 asked about this short period of time.
 
Congratulations! Isn't the stamp the most beautiful thing that you have ever seen? OK, I know it's dull and boring but I can't stop staring at it. I can't wait for the card.
 
You are right.
Section 245(k) enables a person who is adjusting status in an employment-based category (whether on the basis of a labor certification or in one of the special Green Card categories that does not require a labor certification or job offer) to adjust, even if s/he has been out of status or worked without authorization for less than 180 days. This provision does not require an immigrant petition or labor certification to have been filed on or before any particular date and there is also no penalty fee involved.
