I140 approved on 17th...

My I140 got approved on 17th but the 485 is still pending, I am a concurrent filer and my lawyer says that "they are supposed to adjudicate the I-140 and I-485 together". Did anyone go through this kind of issue?

Hi All !!

Can you all please post next time with the RD/ND and FP date etc. If you don't do that everyone else here is left in dark on what processing is going on in TSC.

Please be more informative in your posts and add your RD/ND/PD/FP/category info to your messages or signatures.

I went thru similar situations as you. My 140 was approved in Oct 14th 2004, I did my second FP on Oct 22nd 2004 and 485 was approved on Dec 10th 2004. A gap of almost 2 months. Mine was a concurrently filed case, RD/ND: March 14th 2003 for both 140 & 485. So situations like yours do happen. Your approval may come soon, hopefully. Good luck.

I am still waiting for our approval notices though.

Can you give your PDs too..

I understand CIS is sometimes adhoc in approving cases and some latest petetions are being approved and give optimism to latest cases.

Just to check the pattern of CIS approvals, you approved please mention your PD dates also.

FP: Sept 28, 04
I140 Approved on Dec 15th, 2004. But, no news of 485 yet..Please let me know if there any developments in ur case..

Hi All,
Today I received a notice that my I-140 is approved. I was in the opinion that 140s of all the earliast PDs are being approved. I was proven wrong. Mine is Mar-2003 PD. (My early 2001 PD was remanded to state though).

Since this approval came before retrogression takes affect, will I be luck for my I-485 ? I know there are many approved I-140 petetioners who are patiently waiting.

Many Congrats. Hopefully you will get 485 approval before the retrogression kicks in. However even if you don't get it, you can still use AC21 to change jobs using EAD since a major step of 140 is clear now and 485 is your own petition so you are in safe category now.


Tell us what was your exact 140 RD or ND and what was your exact FP date. I am trying to form a pattern here. Thanks in advance.

Sure, I will let you know if there is any further developments. One of my cousin got approved I140 on 13th and with in 2 days 485 also got approved. Looks like our file is in the wrong hands.

Just received an e-mail from USCIS a few minutes ago, and my I-140 has been approved this morning. It has been a long waiting since last May. I wish everyone in this forum will be receiving your Christmas gift from USCIS during the holiday season, too. Here are my details:

I-140 ND: 5/5/2003 NIW LUD: 12/18/2003 AD: 12/21/2004
I-485 ND: 12/17/2003 LUD: 11/15/2004 AD: ?
FP Date: 11/2/2004

My Pd is sometime in Mar-2003, 140-485 ND is 23-Dec-2003. FP is done on Nov-3-2004. I-140 approval notice recd today in the mail and also LUD is updated today.
