My sister applied for naturalization based on marriage to USC and she had her interview and UCIS told her that her FBI check is pending. Her priority date was in April. She had her fingerprints in July, interviewed in October and now she and her husband are going for divorce.
1) My question is does she need to withdraw her application at this last stage?
2) Can they file for divorce in the mean time while she is waiting for oath?
3) Can BCIS find out if someone's divorce is pending in court?
4) If she withdraws N-400, would it have any effect when she will try to naturalize after another two years based on 5 year LPR status? Or based on joining military?
