For past 6 years I am working for same American Company who relocated me to their branch office in Dubai in Oct 2007. Before departing to Dubai, my company applied for N-470 and re-entry permit (valid for 2 years) which were approved for both me and my wife. My assignment is for indefinite period of time and I am not sure when will I be back. However, I still have my residence in the state, all utilities are still in my name, have valid bank account, driver license and do file my federal and state taxes. Presently, my friend is living in my house which I own, and she takes care of the mortgage payment.
Since our re-entry permits were about to expire, so we decided to take a short trip after discussing with US consulate in Dubai. We spent about 10 days there and then came back to Dubai. During our visit we completed application forms, signed and dated 2 days before our departure, prepared all necessary documents to attach with and gave it to a friend of mine to mail it to TSC.
Here is some background and relevant information:
1. Became LPR on Feb 28, 2005
2. GA state resident since 1996, own home since Jan 2001 and were living there before relocation
3. Relocated (self) to Dubai on Oct 27, 2007 and my wife and kids followed on Aug 23, 2008
4. Had few trips to state (2 weeks to a month) between Dec 1007 and Aug 2008
5. Tried to apply for re-entry permit from US Dubai consulate, but they told me to go to US and
apply there
6. Travelled to US last month for 10 days (2 months before expiration of REP)
7. We will be travelling to US again around last week of June for 2 months
Now I have some question which will require your expert opinions/recommendations/suggestions:
1. Can we mail the application now or wait until 90 days are completed. According to 8.CFR.316.5 if
an applicant returning to same state or district where he/she last resided, the applicant will not
have to wait 90 days to file N-400.
2. I am sending Mortgage statement, utilities bill, copy of N-470, 5 year tax transcripts, bank
statement and my employer letter along with N-400. Any other document I need to send along
with them
