Filling for Wife Citizenship

Hi,

1) I am currently on H1B visa and my wife is on Green card (permanent resident). In May 2007 I will file for my wife's citizenship. Do I (H1B) have to file anything with my wife's citizenship of should I wait for few months till my wife gets citizenship?

2) What papers do I need to fill for filling for citizenship for my wife?

3) How much time it takes for my wife to get her citizenship if she files in May 2007? I am in Houston, TX.

4) After my wife gets her citizenship should I directly get the citienzip or should I first get EAD -> Green Card -> Citizenship

5) Do I need a lawyer to file citizenship for my wife?

You should wait untill your wife gets her citizenzhip .

N-400 . There is a seperate forum here for applicants filing for Citizenship.Pleasee look through that to get more information.

Without getting stuck in the name check , the average time is 4 months .Please check the N400 forum for threads specific to Houston

Your wife will be able to petition you for a green card . Given that you have a H1B , you can choose to apply for a EAD or not . This process takes about 5 months from the time of application if the application does not have any hitch (no RFE)

5) Do I need a lawyer to file citizenship for my wife?

Not really. It is a very simple process . The Us Citizenship forum should have all the info you need .

How can you file for somebody else's citizenship? Doesn't your wife have to do it herself?

I don't understand question 1, but I can answer questions 4 and 5.

4) You won't get citizenship directly. You will need to file for adjustment of status after your wife gets her citizenship. You will get a green card. If you file for an EAD with your green card application, you should get it before the green card. You will be eligible for citizenship 3 years after you become permanent resident (if you remain married) or 5 years (if you get divorced). You will have to meet certain requirements as well - continuous presence is one of them. There's good info on that at uscis.gov

5) No, unless her case is awfully complicated.

Hi:

As someone else pointed out, you cannot possibly file for your wife's citizenship. It is something she must do for herself.
