Filling AC21?

Hi All,

I have questions on filling AC21. In my case I am working for company “A” in FEB 2006 onwards. I got the H1 through that company (A) in FEB 2006.I applied I-140 in FEB 2006 through that company with substitute labor which they have. And I got the approval for I-140 from that company in April 2006.I got the EAD, Advanced payroll, Fingerprints through that company in 2007 October. I Renewal my EAD, AP through
the same company in 2008.I got the 2yrs approval for EAD.

I have H1 validity upto 02/2010 with company “A”. My Company “A” did not cancel
my H1 and I-140.

Now I changed to company “B” in Jan 2009 and I am working on EAD with company “B”.

Recently my Company “A” is closed in JULY 2009.But still I did not apply AC21.

1. Shall I need to apply AC21 mandatory because my company “A” is closed (or) No Need to Apply? (I heard people getting RFE on filling AC21)

2. Which is the best option to file AC21 or NOT?

3. My company “A” is closed because of that any problems come for my Green card Process or Not?

Please help me. I appreciate you.

-------------------------It is better to invoke AC21. if USCIS sends RFE they will ask lot of documents and if they send NIOD then more money to lawyer.
2. Which is the best option to file AC21 or NOT?
---------file AC21 and keep the copy of documents that you or your lawyer send to USCIS.
3. My company “A” is closed because of that any problems come for my Green card Process or Not?
---------------- you are safe if company closed after I-140 approval.
Please help me. I appreciate you.
