Fillin in N-400 - Spouse's status and Criminal check

I need some help in filling in my N-400 form.

Part 3. Section G. asks about my marital status. I've been separated for about 3 years but haven't divorced legally. The form has only a couple of options, and one of the says X marriage Annulled or other... Should I specify in this section that I am separated? or just select the check box for Married?

With this on Part 8. they ask about my wife's immigration history. Section E-3 asks if she is a lawful permanent resident, which in my case she is not legally in the country so I know I have to write something in the X other section... but what would be the most appropriate thing to fill in in that section?

And at last, I ran a business for a while. however somebody with that was using the same name in the same county where I conducted my business went around scamming people. And so the people that got scammed got together and submitted small claims agains anybody who was conducting business with the same name or even a similar name. I was served 3 times and two of them were discharged and lost one. I know theres is probably 10 more cases for which I wasn't served but now due to court records that I was being sued on those other cases. Can this affect my Moral Character? Should I answer yes to question "Good moral character" No. 16 Have you ever been arrested, cited, or detained by any law enforcement officer? I believe this would be a civil matter and not a criminal case, but still don't know if it can affect my application.

Any help would be greatly appreciated.

you are still MARRIED

She is either an OVERSTAY or EWI (entered without inspection)

If found GUILTY or you are naive enough to plead Guilty or take some "deal" THEN it is likely a problem for N-400 GMC. read 8 CFR 316.10
