Filing two 485 trough different companies

Background:

I am currently working for company A and they started my GC process in Feb-2003 under EB3. LC and 140 approved and waiting to file 485.

In the mean time I got my Masters Degree done and I initiated another GC through company B under EB2. Both LC and 140 approved and company-A PD (feb-2003) was transferred to this case.

Q1: In recent visa bulletin both EB3 and EB2 are current. Attorney said we can leagally file two 485s but not recommended. Just do one 485. Are there any major risks filing two 485s?

Q2: If I have to just pick one, I still think EB2 might come faster but I have to leave my current permanent job(A) and join company-B(consulting firm) to file 485 through-B. Is it worth the risk?

I am not sure how long EB3 might take for PD: Feb-2003.

Please advise. Any suggestions or recommendations are highly appreciated.

----that is correct
Are there any major risks filing two 485s?
--------------risk is that USCIS may send I-485 to local USCIS for interview and that delays the process for 3-5 months

--------------------I will file I-485 on the base of I-140 of A (as you have permanent job) the decision is upto you. FYI you can file I-485 on base of B I-140 and it not needed that you should be working with B at the time of I-485 filing . GC is for future job not for present job

--------------nobody knows about EB3 or EB2 PD in future

Please advise. Any suggestions or recommendations are highly appreciated.

Thanks ginnu

Thank you for your response. I am also leaning towards to go with comp-A.
I have hard time to give up 'B' as that is on EB2 but they won't file 485 until I join them (which is also recommened by attorney). I also understand the risks of leaving 'A' and joining 'B' (I have to keep looking for contracts). When I started GC through-B, I was willing to take that risk and I never had any hope on EB3. Now that both of them are current I am having hard time to go one way or the other. It is like I want my GC quicker and I don't want to take risk -:)

I have couple of questions that might help in my decision.

Q1. Does USCIS process EB2 and EB3 in separate lines? If yes, why are they not publishing processing times separatey? I only see Emp-Based-485 processing times.

Q2. How do they process 485s (I mean in what sequence)? Do they go by Receipt Date OR by Priority Date?

Can you please share your thoughts on this? Thanks again and it really helps.

------------------------------------ask USCIS H.Q and Only they can reply
