Through a married to US citizen, my cousin is now applying for a GC. But here's her situation. She was on OPT when she got married. She and her husband agree to wait for little bit to find out if the married was working or not before filing for the GC. Then problems appeared, untill finally she was out of status for about 7 months but still staying in the married (the married has been a year by now). Things got better and by July 2005 her husband filed the GC for her.
Now she is confused maybe to end the married was the best thing (for whatever reasons). The questions are:
1. If she and her husband decide to get divorce, what would happen with the application?.
2. Assuming that the application will not be valid anymore, if she chooses to stay in the country after the divorce, then marry another US. Citizen, will her future husband be able to aply a petition for her?.
Not that she is already planning to get married again, but she wants to know what are the options.
Anybody can help would be very appreciated.
