Filing Multiple I-140 Simultaneously Using The Same Labor

I joined a company who promised me to process Green
card using a pre-approved labor.

They filed I-140 and I-485 in early Dec and I had my
finger prints last week .

Now I came to know that Attorney used the same labor
for filing I-140 and I-485 for another person appx same time.

He has his finger prints time next week.

I want to know ,how is it possible to file I-140
simultaneously for 2 different persons with the same
orginal Labor certificate .

Now what can I do ?Any Help is appreciated.

I hope it is not the case. You cannot apply two I-140s using one labor unless you withdraw/revoke the first one. If your attorney used the original labor while filing your I-140, they would not have applied the second applicant's I-140 with the original labor (as original would have gone with your filing). Check it out ..... something doesn't seem to be okay.

I am surprised if your attorney/employer did that....

I am sure the lawer used a photocopy as that is what my attorney did too. In my case the one with original labor got approved and the one with a copy is still pending (there was RFE and the attorney responded back requesting USCIS to attach my I-485 to the approved I-140).

I think your attorney might be trying to use this trick to save some processing time for the other person and am sure there is a second labor pending which will be used for the other person once approved.
