Filing I485 when I have changed my employer

Hi,

I was employed with company A, and they filed my labor and I140. I have joined company B recently, and company A has agreed to share with me I140 so that I can save my priority date when company B files my green card.

I was wondering whether I can file I485 myself from the company A's I140. Do I need any kind of documents from Company A to file I485 ? If I need Company A's help, what kind of risk does company A have to take ? It may be possible that I am able to talk to Company A as I have good relations with them - but I need to know what kind of issues are involved in such a case ?

Any reponses are highly appreciated.

when you file 485.....you have to send Employment Verification letter (from company A)......and then you will have to send your current H1/L1 approval notice (preferably from company A).....

your case is very unique......consult a attorney to know your options...

recent paystubs (which is not required but people send it so that they dont get RFE later on for the same...)

You need an employment letter from the company A. But some people have applied without that. Since I-485 approval usually takes more then six months. You can use AC-21 and sail through.
 
I485 with new company?

Your friends who applied for 485 with out working for the 140 sponsered company, are they successfull in 485?

I was in that situation before in 2001... but lawyers didnt allow me to do so, though I had H1 and paystubs ( I had 3 months layoffnotice so everydocument I kept ready.. except employment continuation letter).

If ur friends are successful.. please let me know.. that would change my life.
I still have my I140 approved letter in hand.

------------ you CAN file your I-485, attach the copy of I-140 approval or I-140 filing reciept and job offer letter of A, and can also file EAD , AP while working on H1 with B. nothing is wrong with filing I-485 if working with B. GC is for FUTURE job after I-485 is approved. one can work woth X on H1 and LC, I-140 can be filed by employer Y and you can file I-485 based on I-140 of Y.

------------ they have nothing to do, request them not to revoke the I-140 and get employerment offer letter, and attach with I-485. if the I-485 gets approved BEFORE 180 days then you should work with A once get GC and if I-485 is pending mote than 180 days then you CAN invoke AC21 by sending employer B letter to USCIS to approve the I-485 based on job offer of B
