Filing husband's GC - list of forms to fill out

I will be filing for my husband's GC application soon ( under the category - spouse of US Citizen).

I understand that we need to file the following forms
1) I-485
2) G-325A
3) I-130 (We filed for it a couple of years back and got approved. So we'l just be attaching a copy of the approval notice, correct?)
4) I-131 (optional)
5) I-765 (optional)
6) I-864 . Do I need to fill this out?
7) Medical Exam in a sealed envelope

Anything else?
 
That is the complete list. You do need to fill out that I-864 (affidavit of support). There are also all the supporting documents (see the instructions for each form), plus photographs (again, the instructions tell you how many photos for each form). Good luck!
 
Doesn't the USCIS send you the appt date for FP??

I am also in the same situation. After my husband becomes a US citizen, he is going to file for my GC. I was under the impression that G325A is the FP form and the USCIS will send us the date & time when we have to take it. Only after that the G325A form will be filled out.???? My ignorance. Can you explain in more detail?

Am also curious as to how you got the I-130 files and approved much earlier. Were you already a citizen when you got married to him?

That is incorrect. The 325 is the Geographical Location form showing where you lived for the past years and current year for applicant and petitioner.

Once USCIS gets your application for GC and I-130 is approved they will send you a FP Notice.

So, the forms that I will have to fill out and send to the USCIS as soon as my husband gets his citizenship are:

1. I-130 (which is the actual petion for a relative to stay legally in the uS)
2. I-485 (for my Adjustemnt of Status)
3. I-765 (for EAD, cos' I need to work)
4. I-131 (Advanced Parole document, cos' I may need to travel)
5. G-325 A (For my addresses of stay for the past 5 years)
6. I-864 (Affidavit of Support from my husband)
7. I-693 (for my medical clearance)

I hope I am right. Am I?

One more question, can I send all these forms together at one go? Also, does anybody have any idea, if I can file these forms the very next day after my husband becomes a citizen? Any idea..when I can quit my current job (H1) and still be legally staying in the US. I was given to understand that as soon as the forms are accepted by the USCIS, stay will be legal..Do all the forms have to be accepted by the USCIS ??

The reason I am asking these questions are, we are on a long distance relationship now (after a year of marriage) and its getting to be real tough on us now :-(. I would like to move down to my husband's place as soon as possible.. Does anybody have a similar experience?? Any help on this matter will be greatly appreciated.

That is correct - one thing to note that with the I-130, you need to provide a G-325a for both yourself and your husband. The I-130 and I-864 both are signed by the petitioner and the I-485, I-131, I-765 are signed by you.

Yes, you can file as soon as your husband becomes a citizen. As part of the supporting docs for the I-130 you will need to provide proof of citizenship (Naturalization certificate, Passport etc.).

Yes, as soon as you receive a received date for your I-485 (Adjustment of Status), you can live legally in the US.

You have clarified our doubts.. Than you very much. One more quick question. You mentioned that -

Will a copy of the "naturalization certificate" alone be enough as the supporting docs for I-130, cos' if we were going to wait for him to get his passport, that would be another 1-2 months right?

We are crossing our fingers that he gets his Oath letter for US citizenship soon. Hopefully that will not be delayed.

Yes you can file the next day after husband gets citizenship.

Yes, since you are already in the USA, you file the entire package

As soon as form are received and accepted by USCIS, you will be legally elgible to be in USA.Your status is considered "pending"

Your husband needs to contact the "IRS" to request "official transcripts for his tax returns. The number is 1-800-829 -1040. There is no cost.
He will need to request the 2005, 2004, 2003 tax returns (they have changed the requirement to only one year but I would suggest requesting up to 3 years for the record). At the end of the 2006 year (which is the impertinent year for you guys, make sure he obtains his w-2's and tax information) for the purpose of the I-864- Affidavit of Support.

For more than one reason you need to be living together with joint bank accounts, joint bills, joint lease agreement, joint insurance,etc. for proof that marriage is a "valid" marriage. A lot of these joint documents require that you have Social Security Number. (Oh but you are H1)ok, sorry

You have been a great help Neshawn!! Will ask my husband to request for his official transcripts. And I am going to get ready with all the forms. As soon as the forms get accepted by the USCIS we will start living together. Hopefully by the time of interview (which is when I guess they check the validity of the marriage & question it), we will have been living together for atleast a few months with everything else done jointly (like the bank accounts, joint bills, etc)

Just to note, if you husband still has copies of his filed 1040 and W-2s (i.e. tax returns), theres no need for tax transcripts, he just can use these.
 
That's cool dr_lha..

Then he does not have to request it from the IRS. Am sure he will be having copies of filed 1040's and W2's for the past three years.

This post is very helpful to people getting ready to file paperwork for their spouses. I have a few more questions

1. Does I-864 form have to be notarized?

2. Is the photo requirement for I-131 (Advance Parole) the same as for others? ie for I-485 and I-765. The I-131 instructions say that the photo has to be the 'side view' as used to be the case a couple of years back while I-485, it says 'frontal view'? Can someone please clarify this?

3. Do we need to send photocopies of *all* pages of the applicant's passport?

4. Other than the marriage certificate, do we need to send any additional supporting documents at this time with the applicaiton packet to prove that the marriage is valid . Eg - a few marriage photos, joint bank statements, joint car insurance, joint lease papers etc?
 
The photo requirment is the same for all forms now. I know because I sent side view with my recent I131 application and they returned them. It is now frontal view for all forms.

You only need to send the details page of the passport, the one with photo, number etc.

It's been a while so I'm not certain about the last two. I believe I864 must be notarized and that no, you don't need to send additional information beyond what is requested.

I guess I will be applying from Florida cos' my husband lives there, though I live in Chicago currently. Where do I send the forms while filing for GC (After my husband becomes a US Citizen :rolleyes: )? I have this doubt cos' one of the forms says it is to be sent to the Texas Service Center, while another says its to be sent to Chicago irrespective of the state you live in. What is this Chicago lockbox?? Please can you explain.

Hi,
I am in H1B married to USC. She is a student . Does she need to fill the I-864 for me .

I am asking this question as her pay is well below the 125 % of poverty line.
