Filing H1B with wrong data of birth

My lawyer filed my H1B application with wrong date of birth and it got approval. Should I reapply the H1B or just ask the INS to make a correction? If so, what visa status I am holding now? the former F-1 or the H1B with wrong birthday? Is there any problem I will have after my practing training expire but the DOB has not been corrected by INS?

Any one has the similar situation, I hope my lawyer is not the only one made such kind of mistakes in the world!

Your lawyer just needs to file for copy of H1 approval, but with
the correct birth date (and explain the reasons for the change).
you probably continue with the H1 status.
